Weld County,Colorado <br /> PROJECT No.B 1400202 <br /> _o u N Tx Book 1 -Contract <br /> 4.3 Completion Deadlines <br /> 4.3.1 Project Completion Deadline <br /> The Contractor shall achieve Project Completion within the deadline therefore set on Exhibit B. <br /> Said Deadline, as it may be extended hereunder, is referred to as the "Project Completion <br /> Deadline." <br /> 4.3.2 Final Acceptance Deadline <br /> The Contractor shall achieve Final Acceptance within 90 days after Project Completion <br /> Deadline. Said deadline for Final Acceptance, as it may be extended hereunder, is referred to as <br /> the "Final Acceptance Deadline." <br /> 4.3.3 No Time Extensions <br /> Except as otherwise specifically provided in this Section and Section 13, the County shall have <br /> no obligation to extend the Completion Deadline and the Contractor shall not be relieved of its <br /> obligation to comply with the Contract Schedule and Final Acceptance Deadline by the <br /> applicable Completion Deadline for any reason. <br /> 4.4 Contract Schedules <br /> The Contractor shall deliver the Work in accordance with the Contract Schedules, as described in <br /> Book 2, Section 2 (Project Management). Such schedules shall also be the basis for determining <br /> the amount of monthly progress payments to be made to the Contractor. <br /> 4.5 Recovery Schedule <br /> The Contractor shall submit a Recovery Schedule in accordance with Book 2, Section 2 (Project <br /> Management). All costs incurred by Contractor in preparing and achieving the Recovery <br /> Schedule shall be borne by Contractor and shall not result in a change to the Contract Price, <br /> except to the extent that a change in the Contract Price is permitted in accordance with Section <br /> 13. <br /> If a Recovery Schedule would be required in order to meet a Completion Deadline due to an <br /> event which is the County's responsibility as described in Section 13.3.1.2, the County shall have <br /> the right in its sole discretion to decide whether to allow a time extension (with no extended <br /> overhead or other delay or disruption damages payable except as provided in Section 13.5.2) or <br /> to require implementation of the Recovery Schedule without such time extension. In such event <br /> Contractor shall submit to the County at least two alternative Change Order forms, one of which <br /> shall include a Recovery Schedule and show the proposed Acceleration Costs associated with the <br /> Recovery Schedule, and the other of which shall provide for an extension of the Completion <br /> Deadline without any increase in the Contract Price except as provided in Sections 13.3.1.1 and <br /> 13.5.2. If the County elects to implement the Recovery Schedule in lieu of a time extension, the <br /> County shall issue a Change Order increasing the Contract Price to account for additional <br /> Acceleration Costs, if any.
