1861.E"� <br /> Weld County, Colorado <br /> PROJECT NO.B 1400202 <br /> u nil go __ Book 1 -Contract <br /> 4.0 TIME WITHIN WHICH PROJECT SHALL BE COMPLETED; SCHEDULING <br /> 4.1 Time of Essence <br /> Time is of the essence of the Contract. <br /> 4.2 Notices to Proceed <br /> 4.2.1 Issuance of Notice-to-Proceed 1 (2015) <br /> The Contractor shall begin performance of certain limited Work as directed and described in <br /> Notice-to-Proceed 1 (NTP 1) issued by the County. The amount to be paid to the Contractor for <br /> Work performed pursuant to NTP1 shall not exceed the maximum amount payable for NTP1 as <br /> outlined in Book 2, Section 2.1.2. The County shall issue NTP1 upon Acceptance of the Initial <br /> Schedule in accordance with Book 2, Section 2 (Project Management) and Approved Quality <br /> Management Plan (QMP) in accordance with Book 2, Section 3 (Quality Management). The <br /> Contractor shall submit the QMP for design-related work to Weld County for approval prior to <br /> commencing any design-related work for NTP 1. The entire QMP for all remaining work on the <br /> Project must have Weld County's approval before commencing any construction-related work <br /> for NTP 1 or subsequent NTPs. The Contractor shall fully implement the approved QMP. Within <br /> ten Working Days after Contractor's submittal of the Initial Schedule to the County, the County <br /> shall either accept the Initial Schedule and issue NTP1 or provide Contractor with reasons why it <br /> is unable to Accept the Initial Schedule. In the event that the County fails to either Accept the <br /> Initial Schedule and issue NTP 1 or provide reasons why it is unable to Accept the Initial <br /> Schedule within ten Working Days after Contractor's submittal of the Initial Schedule to the <br /> County, such delay thereafter shall constitute a County-Caused Delay. <br /> 4.2.2 Issuance ofNotice-to-Proceed 2 (2016) <br /> The Contractor shall begin performance of the remainder of the Work as directed and described <br /> in Notice-to-Proceed 2 (NTP2) issued by the County. The amount to be paid to the Contractor <br /> for Work performed pursuant to NTP2 shall not exceed the maximum amount payable for NTP2 <br /> as outlined in Book 2, Section 2.1.2. <br /> 4.2.3 Issuance of Notice-to-Proceed 3 (2017) <br /> The Contractor shall begin performance of the remainder of the Work as directed and described <br /> in Notice-to-Proceed 3 (NTP3) issued by the County. The amount to be paid to the Contractor <br /> for Work performed pursuant to NTP3 shall not exceed the maximum amount payable for NTP3 <br /> as outlined in Book 2, Section 2.1.2. <br /> 24 <br />
