PR-04, Colowyo Coal Mine C1981-019 39 August 2016

the Collom pit, and completed in the Trout Creek Sandstone (see Stipulation 18). The well will
be monitored quarterly for water level and field water quality parameters, and annually for a full
suite of laboratory parameters.

A future spoil water monitoring well will be drilled into the reclaimed Collom pit, at the lowest
point, in order to monitor and measure the potential development of a spoil aquifer.

H. Transfer of Wells - Rule 4.05.14

No transfer of wells is proposed. All monitoring wells will be reclaimed prior to bond release.

I. Water Rights and Replacement - Rule 4.05.15

CCC has demonstrated that no owner of a vested water right is proximately injured.

J. Discharge of Water into an Underground Mine - Rule 4.05-16

No surface water will be discharged into underground mine workings.

K. Stream Buffer Zones - Rule 4.05.18

With PR-03, the Division approved surface mining activities through several creeks that are large
enough (drainage area greater than one square mile) to require buffer zones or approved
exceptions per Rule 4.05.18. This is based on a finding that the original stream channels will be
restored, water quality and quantity will not be adversely affected, and appropriate riparian
vegetation will be reestablished, as necessary.

A large section of Little Collom Gulch will be directly impacted by the pit, spoil pile, and
Section 25 Pond. To protect the section of this creek below mining, CCC has committed to build
and maintain clean water diversions and the Section 25 Pond. After mining, CCC has committed
to reestablish the profile and function of Little Collom Gulch.

The Division also approved haul road crossings of Wilson Creek and Jubb Creek. At these
crossings, CCC will employ BMPs and will perform any necessary reclamation as soon as
practicable.

L. Probable Hydrologic Consequences

Based on an assessment of drainages in the Collom area and the fact that all runoff from the mine
area is to be either diverted around the mine or retained in sedimentation ponds, no significant
