3.6 Current Land Use <br /> The IXURoyal Tiger site is currently an abandoned mine property on privately owned <br /> land_ Mining operations at the site ceased in 1939(CDPHE,2002). Surrounding land <br /> ownership is mixed between Federal and private interests(CDPHE, 2002). <br /> 3.7 Proposed Land Use <br /> The IXURoyal Tiger property is part of a proposed open space land acquisition by the <br /> Buyers. Assuming the transaction is completed,the proposed land use is as a <br /> community asset for recreational use, natural preservation,and historical preservation. <br /> 4. VCUP PROGRAM INCLUSION <br /> 4.1 Site Eligibility <br /> Is the applicant the owner, or the owner's designated representative, of the property? <br /> The applicant,Summit County,along with the Town of Breckenridge, has entered into an <br /> option to purchase the property.The property owner, B&B Mines, Inc. has authorized the <br /> Buyers to submit this voluntary clean-up application with the understanding that the work <br /> will be performed by the Buyers in the event that the purchase is completed. <br /> Is the property listed or proposed for listing on the National Priorities List of Superfund <br /> sites established under the federal act(CERCLA)?No. <br /> Is the property the subject of corrective action under orders or agreements issued <br /> pursuant to the provisions of Part 3 of Article 15 of this Title(25)or the federal <br /> "Resource Conservation and Recovery Act of 1976,`as amended?No. <br /> Is the property a facility that has or should have a permit or interim status pursuant to <br /> part 3 of Article 15 of this Title(RCRA Subtitle C)for treatment, storage or disposal of <br /> hazardous waste?No. <br /> is the property subject to the provisions of Colorado Revised Statutes, Part 5,Article 20 <br /> of Title 8(Underground Storage Tank—State Oil Inspector)?No. <br /> 4.2 Qualified Professionals <br /> 4.2.1 Environmental Assessments <br /> The environmental assessments referenced in this report were performed by CDPHE <br /> and ABC in 2000. Mr. Kevin Mackey of CDPHE was the primary investigator for the <br /> agency. Mr. Mackey is a qualified environmental professional with significant experience <br /> investigating abandoned mine sites. The work at the IXURoyal Tiger site was performed <br /> in general conformance with the United States Environmental Protection Agency's <br /> (USEPA)Engineering Evaluation and Cost Analysis guidance for non-time-critical <br /> removal actions(CDPHE,2002). CDPHE has performed a number of similar <br /> assessments to support the Brownfields and Voluntary Clean-up program objectives. <br /> ABC is a Colorado-based corporation that has performed environmental assessments, <br /> investigations,and remediation projects since its inception in 1983. Qualified ABC <br /> employees performed and supervised the environmental assessments referenced in this <br /> application. A copy of ABC's Statement of Qualifications from 2001 is included in <br /> Attachment A to this document. <br /> IXURoyal Tiger VCUP Application Page 11 of 33 <br />
