We <br /> appreciate your comments and feel confident that we can address your concerns to ensure that this <br /> reclamation project meets the goals of all involved parties. Please include this Ietter as an addendum to <br /> our submitted Vcup application, in order to respond to the specific comments in your letter dated <br /> September 22, 200C The following responses are provided in the same order as your comments: <br /> 9.6.1 Improve Conveyance of Adit Discharge Around the Fine Grained Tailings <br /> Paragraph 1: Monitoring and maintenance (O&M) of the reclamation and specifically the adit <br /> conveyance will be completed by Town and County personnel. Both the Tbwn and County have <br /> dedicated funding sources for open space protection and both sources allow for O&M on open space <br /> properties. The Town's sales tax revenues for open space do not sunset, and will be available for O&M <br /> in the indefinite future. The County's dedicated open space funding does not sunset until 2011, and the <br /> Board of County Commissioners is committing under the Consent Decree to the necessary long-term <br /> O&M on the subject open space properties. <br /> Paragraph 2:The anticipated design flows for the adit conveyance will be 200gpm at a minimum. This <br /> capacity will provide the ability for the channel to carry substantially over double the maximum <br /> observed flows, and allow for anticipated iron hydroxide buildup without overtopping of the conveyance. <br /> Paragraph 3: The application notes that the County and Town have not yet determined whether the <br /> road will continue to be utilized following reclamation. In the event that the road remains operational, <br /> the culvert will be sized to convey in excess of 200 gpm and an overflow trench will be placed in the <br /> road to insure that the adit water moves to the appropriate area in the event of culvert freezing. In the <br /> event that the road is decommissioned, no new culvert will be installed. Under this scenario the <br /> discharge below the lined sections of the adit conveyance will be armored as necessary to insure it has <br /> the capability to convey 200 gpm to the appropriate location without eroding. <br /> 9.6.2 Create Additional Wetland on the south side of the Swan River Valley Adjacent to the site- <br /> Paragraph 1: The proponents agree that a pre-construction survey of this portion of this site is <br /> necessary to provide sufficient detail for engineering and post-construction review.
