The pond has drained and only a small amount of water has pooled at the base of the <br />pond. As was noted in the Division’s May 10, 2016 inspection report, water is discharging from the original <br />spillway that was decommissioned and was replaced by the currently approved spillway in 2005. Given the pond <br />elevation, the inlet of the original spillway was visible. It appears the operator attempted to cap the inlet of the <br />spillway which has subsequently rusted away allowing the original spillway to discharge. The pooled water was <br />below the elevation of the inlet of the approved primary spillway. The Division’s May 10, 2016 inspection report <br />required PSCM to take action to ensure that the previously permitted spillway no longer discharged water and that <br />the pond would function under is currently approved design. Based on a conversation with Jerry Nettleton; who is <br />overseeing the permit compliance of the Peabody Sage Creek Mine, PSCM has been in contact with the local <br />water commissioner to ascertain if any modifications of the pond would be required to leave the pond as a <br />permanent feature. According to Mr. Nettleton, the Division of Water Resources may require that the pond design <br />be modified to allow the landowner to release water from the pond if necessary. To comply with this possible <br />requirement, PSCM may have to modify the pond embankment and/or spillway. According to Mr. Nettleton, they <br />would like to possibly address the drainage from the decommissioned spillway at the same time they modify the <br />pond to comply with the requirements of the Division of Water Resources. While the Division understands this <br />request, this issue must be addressed in a timely manner. PSCM shall do the following: <br /> Remove the original corrugated metal culvert spillway that was decommissioned, and backfill and repair <br />the embankment in accordance with the approved design. This activity must be completed by August 12, <br />2016. <br /> <br />or <br /> <br /> Submit a Technical Revision to update the design of Pond 004 if necessary to comply with the Division of <br />Water Resources requirements.
