Colorado Division of Reclamation, Mining and Safety <br />July 15, 2016 <br />Page 2 <br />Response: The text has been revised to refer to Map 2.05.4(2)(e)-1. <br />Section 2.04.7 <br />1. The flow duration curves for the San Miguel River at Naturita provided in the permit are <br />from 1965. Is this information still applicable for 2016? <br />Response: Section 2.04.7 has been revised to remove reference to the flow duration <br />curves for the San Miguel River at Naturita from 1965 and instead rely entirely on data <br />from the USGS Monitoring Station near Nucla, CO for San Miguel River flow data. <br />Section 2.05.6(3) <br />1. Page 17 of the above referenced permit section refers to 1997 NOAA evaporation rates <br />for, semi -arid climates. Please clarify if the 1997 NOAA evaporation rate for, semi -arid <br />climates is still applicable. <br />Response: The reference on page 17 has been changed to NOAA-National Weather <br />Service, Montrose No. 1 Evaporation Station. However, the evaporation rate is still <br />applicable and has not been changed. <br />2. Page 19 of the above referenced permit section refers to effluent requirements specified <br />in the NPDES Permit. Please cite, in this paragraph where the NPDES Permit resides in <br />the permit document. <br />Response: Page 19 of the above referenced permit section has been revised to indicate <br />that a copy of the approved NPDES permit is on file at the New Horizon North Mine <br />office and is available for review at the Division's request. <br />3. Page 23 of the above referenced permit section refers to Figure 2.05.6(3)-1 and uses <br />terminology (Dakota Sandstone, low wall and dryland pasture) that does not appear on <br />the figure. Please utilize the same terminology on the figure as used in the discussion and <br />update the figure as needed. Also, show on the figure the direction of mining. <br />Response: Page 23 of the above referenced section has been revised to remove reference <br />to Dakota Sandstone, change references to low -wall to backfill, and to include a reference <br />to Map 2.05.5-1, Post Mining Land Use regarding areas reclaimed as Dryland Pasture. <br />Figure 2.05.6(3)-1 has also been revised to show the direction of mining. <br />4. Please explain if NPDES 001 and SW -N3 were sampled for IDS and flow after 2000. <br />Also, explain the rational for, only averaging through the year 2000 if these monitoring <br />sites have been sampled since 2000. <br />Response: NPDES 001 and SW -N3 are New Horizon Mine (C-1981-008) monitoring <br />sites that were used for baseline data for New Horizon North Mine.
