PERMIT #: M-1981-185 <br />INSPECTOR’S INITIALS: LJW <br />INSPECTION DATE: June 30, 2016 <br /> <br /> <br />Page 3 of 7 <br /> <br />TR-5 also required the restoration of the Little Deadwood Gulch immediately adjacent to the Chief Portal area. <br />Due to enforcement issues by the US EPA and the Army Corps of Engineers (ACOE), the restoration has yet to <br />gain approval and work commenced. A temporary culvert was installed (shown in Photo Three) to maintain <br />the integrity of the gulch and prevent stream flows from being diverted into the Chief Portal work area. Once <br />the permitting process is complete through the EPA/ ACOE the rest oration activities shall commence exactly <br />as approved in TR-5. <br /> <br />Discussions of more complex construction plans within Little Deadwood Gulch at the Chief Portal go beyond <br />the scope of the approved plans of TR-5 which must be completed by the October 15, 2016 compliance date. <br />If the operator wishes to move forward with these changes, the plans and designs must be reviewed and <br />approved by the Division prior to construction. Plans should be submitted as a separate TR and should include <br />other agency approvals. The Division needs the TR submittal by no later than August 15 th in order to have <br />sufficient time to review the plans and address any issues with the operator. Otherwise, the requirements for <br />restoration of Little Deadwood gulch must be complete as approved by the Division and other agencies by the <br />October 15, 2016 compliance date. <br /> <br />May Day 2 Area <br /> <br />The May Day 2 area was in very similar condition as the October 2015 inspection completed by the Division. <br />No activity has taken place at the May Day 2 area. The operator indicated that ACOE is requiring the <br />installation of a series of culverts where the access road crosses Little Deadwood Gulch at the May Day 2 area. <br />Photo Four shows the approximate future location of the culverts. The portal at the May Day 2 area is <br />partially collapsed and the near vertical slope above the portal appears unstable. Once the ACOE plan is <br />approved the operator has indicated work will commence quickly. This includes the removal of waste rock <br />debris and installation of the culverts as approved under TR-4. <br /> <br /> <br /> <br />May Day 1 Area <br /> <br />There has been some minimal activity at the May Day 1 area. New survey flags were observed on the bench <br />above the portal indicating that further work is forthcoming. These survey flags were noted by the operator <br />as points for the approved slope stabilization monitoring plan being implemented. The portal remains closed <br />with a locked gate, and the surrounding slopes buttressed with the placement of large boulders. The area <br />above the portal has been stabilized with wire mesh and rock bolts. Photo Five shows the portal with the <br />locked gate and buttressed slopes as well as the rock bolts and wire mesh. The Mill Portal door was secure <br />during the inspection. The operator and inspectors went into the mill area. Lighting was poor but no issues <br />were immediately apparent. A variety of equipment was observed throughout the May Day 1 area. The <br />surface conditions of the area are largely unchanged from the October 2015 Inspection. <br /> <br /> <br /> <br /> <br /> <br />
