I, <br /> Transit Mix Concrete Co. <br /> EXHIBIT I- Soils Information (Rule 6.4.9) <br /> 180) Comment: The text states that topsoil availability within the predominant map unit(MU <br /> 77)in the proposed mining area is limited and ranges from 0-6 inches. The proposed <br /> reclamation plan includes replacing topsoil on disturbed land at an average depth of 6 <br /> inches. Therefore,does the applicant anticipate the need to import topsoil for reclamation <br /> (if less than 6 inches is available to salvage)? If so, the applicant should include this <br /> proposed activity in Exhibit E. Otherwise, any changes to the reclamation plan may be <br /> considered at a later date through the revision process. <br /> Response: The Exhibit I text has been revised to address this comment. Transit <br /> Mix does not anticipate the need to import topsoil,but a Technical Revision will be <br /> submitted if additional topsoil is necessary. <br /> EXHIBIT J-Vegetation Information(Rule 6.4.10) <br /> Federally Listed Plant Species <br /> 181) Comment: The text states that the proposed permit area is within the geographic range <br /> of the federally threatened Ute ladies'-tresses, a species of orchid. USFWS is considering <br /> requesting surveys be conducted for this species, and if necessary,the survey will be <br /> completed in summer 2016 in suitable habitat at the proposed access road crossing for <br /> Little Turkey Creek,the only area where disturbance could affect the plant. Please <br /> commit to providing the results of these surveys to the Division. <br /> Response: Transit Mix conducted a habitat assessment(not a plant survey)for <br /> endangered species and met with a USFWS biologist onsite. Regarding the <br /> possibility that Ute ladies' tresses,USFWS agreed that no suitable habitat exists,the <br /> species is not expected to occur,no plant survey will be needed,and that the project <br /> would not affect the species. These conclusions will be reported in the Biological <br /> Assessment being prepared for US Army Corps of Engineers to submit to USFWS <br /> to conduct Endangered Species Act consultation. The Exhibit J text has been <br /> revised to address this comment. <br /> Vegetation Community Descriptions <br /> 182) Comment: In some of the vegetation community descriptions (i.e., riparian woodland, <br /> mountain shrubland, grassland), some Colorado state-listed noxious weed species were <br /> identified, including: Dalmation toadflax, Common teasel, Canada thistle, Bull thistle, <br /> Common burdock, Common mullein, and Musk thistle. Please submit a weed <br /> management plan that includes measures for controlling particular species identified in <br /> this exhibit. <br /> Hitch Rack Ranch Quarry(M-2016-010) <br /> Response to Comments—July 14, 2016 <br />
