Name of Addressee <br /> Page 2 <br /> Date <br /> on June 22, 2019. <br /> The permit that was issued for the Golden Eagle Mine via Permit Renewal RN-01 had a 5-year permit <br /> term, from January 24, 1989 to January 25, 1994. Basin Resources Inc was the permittee at the time the <br /> application for Permit Renewal RN-02 was submitted on September 7, 1993. The RN-02 application, <br /> however, was not submitted in time to allow the company to continue operating past the RN-01 permit <br /> expiration date of January 25, 1994. <br /> The Division issued its Proposed Decision to Approve RN-02 on January 21, 1994. The RN-01 permit <br /> expired on January 25, 1994. Basin Resources, at the Board's January 25, 1994 meeting, sought and <br /> obtained temporary relief from the Board, allowing the company to continue operations under an expired <br /> permit. <br /> The Division's RN-02 Proposed Decision was appealed by an objector(Raton West-Baldwin Ltd)to the <br /> Colorado Mined Land Reclamation Board. The appeal was first heard by the Board at its March 1994 <br /> meeting, and continued through the Board's April 1994 and May 1994 meetings. <br /> The objector's issues were eventually resolved to the point that the Board,at its May 1994 meeting, <br /> approved a modified version of the Division's January 21, 1994 Proposed Decision. A Board Order <br /> documenting the Board's review of the Division's Proposed Decision was signed June 22, 1994. Upon <br /> the signing of the Board Order,the permit associated with Permit Renewal Application RN-02 was <br /> issued, with a five-year permit term from June 22, 1994 to June 22, 1999. Every permit issued <br /> subsequent to this RN-02 permit has had five-year permit terms beginning and ending with June 22nd. <br /> Please therefore find enclosed two signed Colorado Division of Reclamation, Mining and Safety Mining <br /> permit documents for the Golden Eagle Mine associated with the Division's Final Approval of Permit <br /> Renewal Application RN-06 on August 11,2015. An authorized representative of New Elk Coal <br /> Company, LLC needs to sign both documents and have them notarized. One must be returned to the <br /> Division at the above address;the other must be kept on file at the mine office. Once these are signed and <br /> notarized and one is received by the Division, you may discard the permit with the four-year,January 25, <br /> 2015 —January 25, 2019 permit term. <br /> Please feel free to contact me if you have any questions regarding these permit documents. <br /> Sincerely, <br /> Daniel I.
