Mr. Mushinski <br /> Page 2 <br /> July 11, 2016 <br /> The Schwartzwalder Mine Plan Amendment Map shows the revised permit boundary for the <br /> Black Forest Mine is 0.53 acres, which is effectively a release of 8.07 acres from the current <br /> 8.6 acre permit area. Any change to the Black Forest Mine permit boundary must be <br /> considered under a permitting action associated with File No. M-2001-036 and cannot be <br /> processed under a permitting action for the Schwartzwalder Mine. In addition, acreage <br /> releases cannot be processed under a Technical Revision application and can only be <br /> considered pursuant to Hard Rock Rule 4.17. <br /> In order to resolve the permit boundary discrepancy, the Operator may revise the <br /> Schwartzwalder Mine Plan Amendment Map to show the Black Forest Mine and <br /> Schwartzwalder Mine permit boundaries overlap. As noted above, any additions or deletions <br /> of affected areas must be considered under separate permitting actions. <br /> 2. Under Technical Revision No. 24, the Operator is proposing to include a 0.97 acre parcel of <br /> affected land located northwest of the existing permit boundary. The Operator notified the <br /> Division the area was used to excavate borrow material to repair the Glencoe Valley Road <br /> following the flood in 2013. The Division does not consider this to be affected area <br /> associated with the Schwartzwalder Mine. Therefore, the inclusion of the 0.97 acre parcel <br /> into the Schwartzwalder Mine permit boundary is not required and may be withdrawn from <br /> further consideration under Technical Revision No. 24. <br /> 3. The Operator has stated the revised affected area for the Schwartzwalder Mine, after the <br /> addition of 0.97 acres, is 58.52 acres. The Division's records indicate the Schwartzwalder <br /> Mine is currently permitted for 61.16 acres. There is a discrepancy between the Division's <br /> records and the Schwartzwalder Mine Plan Amendment Map. Please provide a detailed <br /> accounting of the permit acreage for the Schwartzwalder Mine, including all past revisions <br /> related to additions and deletions of affected area. <br /> 4. Will the transfer of the Water Treatment Plant (WTP) require approval under the Operator's <br /> Radioactive Materials License? If so,please describe what authorizations are required and <br /> indicate if the Operator has already received approval. <br /> 5. The overall footprint of the new WTP will be smaller than the existing footprint. Will this <br /> have an impact on the amount of spent ion exchange resin from the alluvial water treatment <br /> which can be stored? <br /> 6. Please describe any safeguards which will be implemented at the new WTP to ensure that <br /> electrical service will not be interrupted resulting in the shut-down of the pumps and water <br /> treatment equipment. <br />
