Box 1750 <br /> Canon City, CO 81215 <br /> RE: Schwartzwalder Mine; DRMS File No. M-1977-300; Technical Revision (TR-24) <br /> Dear Mr. Mushinski, <br /> The Division of Reclamation, Mining and Safety(Division)received Technical Revision - 24 for <br /> the above referenced operation on June 17, 2016. The decision date for this Technical Revision <br /> is July 20, 2016. The Division has reviewed the Technical Revision Application and has the <br /> following comments: <br /> 1. The Operator has submitted a Schwartzwalder Mine Plan Amendment Map and a <br /> corresponding explanation intended to correct a permit boundary discrepancy for the <br /> Schwartzwalder Mine. The Operator has stated the discrepancy is related to a 2001 <br /> amendment of the Black Forest Mine(M-2001-036), which lies immediately adjacent to the <br /> Schwartzwalder Mine and is under common ownership by Cotter Corporation. Portions of <br /> the 8.6 acre Black Forest Mine permit boundary overlap onto affected areas associated with <br /> the Schwartzwalder Mine as shown on the Black Forest Mine Exhibit E: Mine Plan Map (see <br /> attached). In addition, Exhibit A under the Black Forest Mine permit references the overlap <br /> of permit boundaries between the Black Forest Mine and the Schwartzwalder Mine (see <br /> attached). <br /> Following the approval of the Black Forest Mine Reclamation Permit on May 28, 2003, there <br /> was no corresponding release of affected area from the Schwartzwalder Mine where the two <br /> permit boundaries overlap. This has resulted in the current situation with two overlapping <br /> permit boundaries. The Schwartzwalder Mine Exhibit C: Mining Plan Map was most <br /> recently revised under Amendment No. 4 (see attached). The revised Exhibit C does not <br /> depict overlapping permit boundaries,but rather shows the permit boundaries of the <br /> Schwartzwalder Mine and Black Forest Mine are separate and distinct. The Division <br /> accepted this map as part of the approval of Amendment No. 4 under the Schwartzwalder <br /> Mine permit.
