Randall, Executive Director | Virginia Brannon, Director <br />July 6, 2016 <br />Rusty Taylor <br />R N P Enterprises, Inc. <br />1135 County Road 30 <br />Craig, CO 8126 <br /> <br />RE: Hertzog Pit, Permit No. M-1981-276, Resolution of Inspection Problem and Option <br />2-Reclamation Work to Reduce Liabilities <br />Dear Mr. Taylor: <br />On May 10, 2016 the Division of Reclamation Mining and Safety (Division) inspected the <br />above mentioned site. On May 19, 2016 the Division mailed you the inspection report. In the <br />inspection report General Compliance with Mine Plan was cited as a problem. According to <br />the current mine plan a maximum of 10 acres will be disturbed at one time. Currently <br />approximately 34 acres are disturbed. <br /> <br />In the inspection report two corrective action options were provided. The first option, Option <br />1: The operator shall submit a technical revision to increase the total maximum disturbance <br />at any given time (which will need to be equal to or greater than the current disturbance). <br />The maximum disturbance includes all land affected by mining that is unreleased <br />(stockpiled, ditches, processing areas, etc.) The technical revision will be due July 18, 2016. <br />Following the technical revision the Division will issue a surety increase to cover the current <br />liability. Under the other option, Option 2: The operator has until October 15, 2016 to make <br />reclamation progress to reduce liabilities. The Division will re-inspect the site after October <br />15 and at that time will update the bond based on current site conditions. Please note that if <br />more than 10 acres remain affected at the time of the inspection a technical revision will still <br />be required to revise the maximum disturbance. The Division required written notification <br />by June 20, 2016 of which option you choose. <br /> <br />On June 30, 2016 the Division received notification that you have selected option 2. <br />Therefore you have until October 15, 2016 to complete as much reclamation progress as <br />possible to reduce your sites liabilities. On or after October 15, 2016 Division staff will re - <br />inspect the site and evaluate the actual cost of reclamation per the approved reclamation <br />plan. <br /> <br />You are encouraged to read through your permit and become familiar with its requirements. <br />If specific questions arise Division staff is available to answer questions and assist you. <br />Please review the estimated bond calculation from May 18, 2016. The Division advises that <br />you focus on the most costly tasks such as; eliminating highwalls and revegetation of affected <br />areas no longer being mined to make the most impact on lowering your reclamation liability.
