The operator had also left the track used for equipment access rough and had added several plastic <br />"wattles" to reduce flow down this slope. This track had also received permanent seed mix. The fines were <br />temporarily disposed of in a pad formerly used for drying of pond dredging material. This pad has adequate berms <br />in place to contain the coal fines and runoff that may fall upon the excavated coal fines. <br />The Division finds that Abatement Step No. 2 is adequately completed. <br />Abatement step No. 3 required the operator to place disturbance area boundary markers at the perimeter of the area <br />affected by the spill and subsequent clean up efforts. The operator had completed this step adequately.
