Brian Watterson of Twentymile Coal Company <br />accompanied the inspection. The focus of the inspection was to observe mitigation efforts to by the operator to <br />comply with abatement steps required by NOV-2016-001. <br />The weather was warm and overcast. There had been a brief late afternoon thunderstorm the receding day. <br />REVEGETATION — Rule 4.15 <br />Vegetative Cover; Timing: <br />Twentymile Coal Company seeded the Fish Creek Borehole coal fine spill repaired area. <br />SLIDES and DAMAGE - Rule 4.12: <br />On May 10, 2016, the Division observed unconfined coal fines spilled outside of the runoff control <br />structures and outside of the approved permit disturbance boundary at the Fish Creek Borehole. The Division <br />issued NOV CV -2016-001 on May 19, 2016. <br />The Division required three abatement steps to mitigate the damage caused by the coal fine spill. The first <br />abatement step was complied with on May 26, 2016. <br />Abatement steps No. 2 and No. 3 were initially required to be completed by June 15, 2016. The operator requested <br />that the time for abatement be extended to June 23, 2016. On June 22, 2016, the Division was informed that <br />abatement steps No. 2 and No. 3 were completed. The Division inspected the repairs to the Fish Creek borehole <br />coal fine spill area on June 23, 2016. <br />The operator had scraped up the coal fines that had spilled to the west of the dewatering borehole. The fines had <br />not reached Fish Creek. The operator had removed fencing to thoroughly remove the coal fines, then re -erected <br />the fences. The area had been scarified, seeded, and straw wattles staked down to aid in erosion control.
