3. Section 2.03-4, page 10, has been revised to include a reference to Exhibit 40 - <br />Jansen Loadout. <br />4. NECC believes the list to be complete. The Division has clarified that a listing of <br />MSHA violations is not required. A previous submittal added the statement that <br />NECC will provide a listing of all current MSHA violations upon citizen request. <br />5. Table 2 in Section 2.03-10, page 12, has been updated to include the renewal of <br />the CDPHE NPDES Permit. Copies of the renewed permit are included for <br />insertion into Exhibit 22 NPDES Permit. <br />6. The title page for Exhibit 14 has been updated and is attached. <br />7. The title page for Exhibit 15 has been updated and is attached. <br />8. Table 10 and Table 11 provide correct current information and no revision is <br />required. <br />9. Table 11 discrepancies are being evaluated and will be addressed with the <br />response to the third adequacy review dated 2/11/16. <br />10. The Table of Contents for Exhibit 19 has been updated and the revision is <br />attached. <br />11. Appropriate sections of Section 2.05 have been repaginated. <br />12. Section 2.05-3(4) has been revised. <br />13. Connectivity Assessment is enclosed. Please insert into Exhibit 10 Water Quality <br />Analysis. <br />14. Non Coal Waste Processing. Historically this waste was disposed of in a <br />permitted landfill at the West Portal area. This area was reclaimed in the early <br />1990s. At the request of the Division this notation was left on the Map 14 for <br />historical clarity (and because final bond release had not been requested and <br />approved). Map 13/14 show dumpster locations. <br />15. Summary of Borehole reclamation: Such information is already been provided to <br />the Division. NECC is evaluating the possibility of reorganizing this information <br />in a more concise manner and will respond with the next submittal. <br />16. Cessation of Operations. New Elk Coal Company -New Elk Mine remains in <br />temporary cessation. NECC is actively seeking contracts but the coal market <br />
