COLORADO Division of Reclamation, Mining and Safety I Depattment c` Natuta� Re SOLVices 1313 Sherman Street, Room 215 Denver, CO 80203 June 7, 2016 Jerry Nettleton Twentymile Coal, LLC. 29515 Routt County Road 27 Oak Creek, CO 80467 RE: Foidel Creek Mine; C-1982-056; Minor Revision No. 297 (MR297) Adequacy Review No. 2 Dear Mr. Nettleton: The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed the above referenced minor revision and sent Twentymile Coal, LLC. (TC) an adequacy review letter dated May 31, 2016. TC responded to the adequacy review with revised pages on June 6, 2016. The Division has reviewed TC's response and several items will need to be addressed prior to the Division's approval of the revision. The following is a list of the adequacy review items that were identified in the Division's first adequacy review letter with TC's response cited along with the Division's response. Items that were resolved were noted as such. 1.) Proposed revised page 2.05-50.3 includes a change in the water treatment methods to be utilized at the Fish Creek Borehole to include treating the water pumped from the mine with a flocculent. This proposed change is not associated with the cleanup of the mine water discharged from the pump resulting in the notice of violation CV -2016-001. Please remove this change in the revised text regarding the water treatment method. This change will need to be processed under a separate technical revision. a. This items has been resolved. 2.) Proposed revised page 2.05-50.10 ends with the last paragraph of the 19RT Dewatering Borehole and Pipeline section. As proposed, a large portion of the 5 -Main North Borehole and Pipelines and Future Passive Water Treatment System (MR14-283, MR15-288, and MR16-2951 section would be cut out of the permit. Please review the organization and pagination of these proposed pages and update as necessary to insure text is not deleted or removed. a. This items has been resolved. 3.) Twentymile Coal proposes to update Map 23c of the permit once the cleanup activity has occurred in order to accurately depict the new surface disturbance boundary. The Division believes Map 29 would also be appropriate to revise to depict the change in the disturbance area. The Division will stipulate the approval of this revision so that the updated maps 23c and 29 be submitted within 15 days of when the cleanup activity is completed. a. The Division will stipulate the approval of the revision as indicated. 4.) Proposed revised page 2.05-50.4 indicates that the coal fines will be cleaned up and transported to a bermed basin on the adjacent 15 -Left Shaft Pad.
