Please direct DRMS to the section of the permit treating this topic or prepare <br />revised pages to the reclamation plan detailing this information. <br />Rule: 4.05.2(3) Exemptions <br />This is a review of the rules relating to exemptions and variances granted. <br />As per Findings RN6 document dated September 2011, and Rule 4.05.2 above, the Division proposes to continue <br />the approved exemption of certain small disturbed areas; (topsand storage and reference area sites) from the <br />requirement to have runoff from the small areas report to sediment ponds. <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.2(5) Sediment Pond Construction <br />This is a review of the rules relating to location of sediment pond construction. <br />The permit adequately addressed this section of the rules. <br />Rule: 4.05.2(6) Effluent Limitations with Respect to Mixing of Drainage <br />This is a review of the rules regarding mixing drainage from disturbed and undisturbed areas. <br />There is no pumping from the pit as mining has ceased, nor any point of surface water discharge. <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.2(7) Compliance with the Water Ouality Control Act <br />This is a review of the rules regarding how the permitee complies with water quality regulations. <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.2(8) Treating Water Discharged from Disturbed Areas <br />This is a review of the rules regarding the installation and maintenance of facilities for treating water discharged <br />from the disturbed area. <br />Through full reclamation, surface runoff appears to be directed appropriately via ditches to sediment pond #2. <br />This section of the rules is adequately addressed in the permit. <br />Rule 4.05.3 Diversion and Overland Flow in Small Watersheds <br />This is a review of rules 4.05.3(1-7) associated with diversion location, design, construction and reclamation. <br />There are two approved permanent diversion ditches for the conveyance of overland flow from disturbed areas to <br />Permanent Sediment Pond 2. <br />There are no, and there is no requirement for, diversions on an existing landslide [Rule4.05.3(5)]. <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.5 (1-2) Sediment Control <br />This is a review of rules 4.05.5(1-2) associated with design, construction and maintenance of sediment control <br />systems. <br />Keensburg Permit Renewal RN7 Prepared by: R.
