PERMIT#:M-1990-041 <br /> INSPECTOR'S INITIALS:MAC <br /> INSPECTION DATE:April 26,2016 <br /> the impoundment.The black liquid within the secondary containment appeared to be a mixture of water, fuel, <br /> oil and lubricants. <br /> The loss of containment from the fuel storage area and from the unlabeled steel drum has been cited as a <br /> problem and will require corrective action by the Operator. Please see the first page of this report for <br /> additional information. <br /> Financial Warranty: <br /> The Division currently holds a financial warranty in the amount of$5,000.00. Pursuant to Rule 4.2.1(1), all <br /> financial warranties shall be set and maintained at a level which reflects the actual current cost of fulfilling the <br /> requirements of the Reclamation Plan. The current financial warranty amount of$5,000.00 is not adequate to <br /> .complete reclamation.The Division will perform a full financial warranty calculation which will take into <br /> account the reclamation of all surface disturbance. In addition, the financial warranty calculation will address <br /> the removal of any structures which are not authorized to remain in the approved Reclamation Plan. <br /> Specifically, the removal of the water treatment building will be addressed in the financial warranty <br /> calculation. <br /> Storm Water MGT Plan: <br /> As noted in the beginning of the report,the Division was accompanied by personnel from the Water Quality <br /> Control Division (WQCD). The WQCD was following up on potential permitting actions related to the <br /> Operator's Discharge Permit for the water treatment plant and Stormwater Discharge Permit. Following the <br /> inspection,the WQCD notified the Division they are working with the Operator to reissue the Discharge Permit <br /> for the water treatment plant.The existing Stormwater Discharge Permit will be incorporated into the new <br /> Discharge Permit. The water treatment plant is not currently operational and is not discharging water into <br /> Gregory Gulch. <br /> Page 3 of 5 <br />
