Ruling and Decree <br /> Case No.2009CW271 <br /> City of Longmont <br /> injury to vested water rights is established, Longmont shall thereupon bear the burden of proof to <br /> show(a)that any modification sought by any other party is not required to avoid injury to other <br /> appropriators, or(b)that any term or condition proposed by Longmont in response to the petition <br /> does avoid injury to other appropriators. The retention of jurisdiction period shall be limited to <br /> claims of injury based upon failure to implement the protective terms and conditions described <br /> herein or failure of such protective terms and conditions to sufficiently protect against injury. <br /> 37. Diligence. The conditional water rights decreed herein are continued in full force <br /> and effect until February 28, 2019. If the Applicant desires to maintain the conditional water <br /> rights thereafter, it shall file an application for finding of reasonable diligence on or before that <br /> date,or make a showing on or before then that the conditional water rights have become absolute <br /> water rights by reason of the completion of the appropriations. <br /> 38. Integrated project. The conditional water rights decreed herein for the Project <br /> Reclamation Features, Coffin Davis-St. Vrain Creek Pump Station No. 1 Exchange, Coffm <br /> Davis-Union Reservoir Exchange and Coffm Davis Ditch, Sherwood Enlargement are part of the <br /> integrated water supply for Longmont's Saint Vrain Integrated Reclamation Plan Project; <br /> therefore, work on any one feature of the Project shall be considered in finding that reasonable <br /> diligence has been shown in the development of all water rights for all features of the entire <br /> Project. <br /> 39. Filing of Decree.
