Ruling and Decree <br /> Case No.2009CW271 <br /> City of Longmont <br /> B. The Coffin Davis Ditch, Sherwood Enlargement, described in Paragraphs <br /> 14 through 20, above. <br /> 31. Conditional rights of exchange adjudicated. The court hereby confirms and <br /> decrees the following conditional appropriative rights of exchange: <br /> A. The Coffin Davis-St. Vrain Creek Pump Station No. 1 Exchange, <br /> described in Paragraph 13.A, above; and <br /> B. The Coffin Davis-Union Reservoir Exchange,described in Paragraph <br /> 13.B, above. <br /> 32. Change of water right. The court hereby approves and decrees the change of <br /> water right, described in Paragraphs 6 through 8, above, for the Longmont Coffm Davis Ditch. <br /> 33. Plan for augmentation. The court hereby approves and decrees the plan for <br /> augmentation described in Paragraphs 9 through 12, above. <br /> 34. Priority of administration. The Application in this case was filed in the Water <br /> Court in the year 2009, and the conditional water rights adjudicated herein for the Project <br /> Reclamation Features, Coffm Davis-St. Vrain Creek Pump Station No. 1 Exchange, Coffm <br /> Davis-Union Reservoir Exchange and Coffm Davis Ditch, Sherwood Enlargement shall be <br /> administered as having been filed in that year and shall be junior to all priorities, including <br /> decreed exchanges,having been filed in previous years. As between all rights filed in the same <br /> calendar year,priority shall be determined by historical dates of appropriation and not affected by <br /> the entry of this Ruling and Decree. <br /> 35. State and Division Engineers. The State and Division Engineers shall administer <br /> the water rights as set forth herein and not curtail diversions by any of the water diversion <br /> facilities described herein so long as such diversions occur in accordance with this Ruling and <br /> Decree and priority administration under Colorado law. <br /> 36. Retained jurisdiction. Pursuant to § 37-92-304(6), C.R.S., the court shall retain <br /> continuing jurisdiction of this case on the question of injury to vested water rights or decreed <br /> conditional water rights of others until ten(10)years following the date on which Longmont files <br /> a notice with the court and the parties in this case that reclamation of the Mine Permit Area has <br /> been completed. In the event that Longmont or any party petitions the court for reconsideration, <br /> the court shall order appropriate notice to be given to all the parties hereto. Such petition shall be <br /> verified,made in good faith, and shall set forth with particularity the factual basis upon which the <br /> requested reconsideration is premised.
