AGGREGATE <br /> Mr.Peter Hays,Division of Reclamation,Mining and Safety INDUSTRIES <br /> May 16,2016 <br /> Page 3 <br /> Restoration and improvements in flood impacted areas within extents of mining related disturbances of <br /> Longmont Distel will be completed in accordance with City of Longmont's Resilient St.Vrain Project as <br /> submitted in the City's Section 404 permit application to U.S. Army Corps of Engineers(Application No. <br /> NWO-2015-02224-DEN). The work proposed under the 404 permit application is summarized in the <br /> "Sandstone Ranch Reach Improvements Summary"as provided by the City and submitted with the <br /> amendment application on March 25, 2016. In a continuing partnership with Longmont, Aggregate will <br /> perform certain post-flood improvements activities in accordance with the"Resilient St.Vrain Project". <br /> The areas for which Aggregate will provide this work are adjacent to its ongoing processing and <br /> reclamation activities and are identified on Exhibit F-1, which was submitted with the amendment <br /> application on March 25,2016. <br /> Rule 6.4.7 -Exhibit G -Water Information—Water information was included under Additional <br /> Information, Water Augmentation as set forth in the cover letter submitted with this Amendment <br /> Application on March 25, 2016. As noted in that letter,the post-mining depletions at Longmont Distel <br /> Operations are covered under Longmont's February 20, 2013 approved permanent augmentation plan <br /> (District Court, Water Division 1,Case No. 2009CW271). A copy of the Decree is enclosed. <br /> Rule 6.4.8 -Exhibit H-Wildlife Information—Wildlife information was included in Exhibit H of the <br /> original permit application and subsequent amendment applications. Extraction activities at the site were <br /> completed prior to this amendment application. No new disturbances are proposed with this amendment <br /> application and the areas of remaining reclamation will be reclaimed as set forth in the approved <br /> reclamation plan, which provides for wildlife habitat and recreation. <br /> Rule 6.4.9 -Exhibit I-Soils Information—Soils information was included in Exhibit I of the original <br /> permit application and subsequent amendment applications. <br /> Rule 6.4.10 -Exhibit J- Vegetation Information—Vegetation information was included in Exhibit J of the <br /> original permit application and subsequent amendment applications. <br /> Rule 6.4.11 -Exhibit K-Climate—Exhibit K has been updated with the most recent climatology data <br /> available for Longmont Station 55116 as compiled by the Colorado Climate Center at Colorado State <br /> University. <br /> Rule 6.4.12 -Exhibit L -Reclamation Costs—The Division currently holds a financial warranty for <br /> reclamation in the amount of$1,483,800. As there are no proposed changes to reclamation of the post- <br /> mining areas to be reclaimed by Aggregate,the current bond amount is expected to be sufficient to cover <br /> Aggregate's remaining reclamation obligation <br /> Rule 6.4.13 -Exhibit M-Other Permits and Licenses—See Exhibit M of AM-003. <br /> Rule 6.4.14 -Exhibit N-Source of Legal Right to Enter—Sources of Legal Right to Enter the properties <br /> within the permit boundary have been previously provided in Exhibit N of the original application and <br /> subsequent amendment applications. <br /> Rule 6.4.15 -Exhibit 0 -Owner(s) of Record of Affected Land(Surface Area) and <br /> Owners of Substance to be Mined—See attached Exhibit O. <br />
