AGGREGATE <br /> Mr.Peter Hays,Division of Reclamation,Mining and Safety INDUSTRIES <br /> May 16,2016 <br /> Page 2 <br /> 3. The Division requires the Applicant to provide documentation giving the signer, John Colin, <br /> the authority to sign on behalf of the company. The authorization document may be in the <br /> form of by-laws, resolution, affidavit signed by corporate secretary, certified secretary <br /> statement or a notarized statement on company letterhead. <br /> Enclosed is the required documentation. <br /> Rule 1.10 -Amendment to a Permit <br /> 4. Rule 1.10.1 states, there shall be_filed with an application for a 112 Reclamation Permit <br /> amendment...the same content as required for an original application, except that the <br /> Applicant will not be required to submit any information which duplicates applicable <br /> previous submittals. However, the Applicant shall clearly describe where in the original <br /> application and supporting documents the information not included in the amendment <br /> application, but necessary to render the amendment technically adequate, may be found. <br /> The Applicant did not provide the following exhibits required to deem the amendment <br /> application complete_for filing: <br /> This revision proposes to update the reclamation plan to reflect the current landscape of the Longmont <br /> Distel Operations site and to identify remaining areas for post-mining reclamation and areas for flood <br /> restoration following the catastrophic flood event throughout the St.Vrain Creek watershed in September <br /> 2013. Exhibit F-1 —Post 2013 Flood Conditions, Restoration, Improvements and Remaining Post- <br /> Mining Reclamation, as submitted with the amendment application on March 25,2016, identifies these <br /> areas. <br /> Rule 6.4.1 -Exhibit A -Legal Description—Legal descriptions for properties within the current approved <br /> permit boundary are set forth in Exhibit A of the original application(1989),Amendment AM-001 <br /> (1994),Amendment AM-002 (1998), and Amendment AM-003 (2000). No additions or deletions are <br /> proposed in this Amendment Application AM-04. <br /> Rule 6.4.2 -Exhibit B -Index Map—See Exhibit B of AM-003. <br /> Rule 6.4.3 -Exhibit C -Pre-mining and Mining Plan Map(s) ofAffected Lands—The only change <br /> associated with Exhibit C requirements as it applies to this amendment application is the map portraying <br /> surface owners of record, as some parcels of land have changed ownership since AM-003. A map <br /> portraying the parcels of land within the permit boundary and those parcels containing land within 200- <br /> feet of the permit boundary is therefore provided in this section. A list of the owners of the parcels <br /> portrayed on the map is also provided in this section. <br /> Rule 6.4.4 -Exhibit D -Mining Plan-All extraction activity was completed prior to this Amendment <br /> Application. Processing and sales of material from an adjacent operation(Permit No.M-1994)is <br /> ongoing. See Exhibit D of AM-003. <br /> Rule 6.4.5 -Exhibit E -Reclamation Plan-Aggregate will continue to reclaim lands affected by its <br /> operations that were not impacted by the September 2013 flood in accordance with the currently approved <br /> reclamation plan as set forth in Exhibit E of Technical Revision TR-04. <br />
