Ruling and Decree <br /> Case No.2009CW271 <br /> City of Longmont <br /> of reclamation of the Mine Permit Area will be planted with natural vegetation. The Project <br /> Property will be managed, in perpetuity,by Longmont's Public Works and Natural Resources <br /> Department as a public open space/greenway, thereby ensuring that such natural vegetation is <br /> established and maintained. Longmont's incorporation of these lands into its parks and open <br /> space system is therefore adequate to satisfy the revegetation and noxious weed management <br /> provisions of§ 37-92-305(4.5)(a), C.R.S. <br /> M. Accounting. Longmont shall keep accurate daily records of Coffin Davis <br /> Ditch headgate diversions, augmentation station deliveries,return flow obligations, return flow <br /> payments, and available net stream depletion credits in order to assist in the administration of the <br /> changes approved herein for the Longmont Coffin Davis Right. Draft accounting forms are <br /> attached hereto as Exhibit D; these forms may be integrated with Longmont's other accounting <br /> forms already developed and used by Longmont. The accounting forms are not decreed herein <br /> and may be modified from time to time upon approval of the Division Engineer. Copies of the <br /> accounting shall be submitted to the Water Commissioner on a monthly basis, and an annual <br /> report shall be submitted to the Division Engineer by November 15th,or such other date specified <br /> by the Water Commissioner. <br /> III. Approval of plan for augmentation. <br /> 9. Structures and water right to be augmented. The following described structures <br /> (the "Project Reclamation Features") are included in the plan for augmentation described herein, <br /> and a new water right is also hereby adjudicated for said structures: <br /> A. Structures. The Project Reclamation Features include all new ponds, <br /> streams and other reclamation features within the"Augmentation Area"of the Mine Permit Area <br /> depicted on the attached Exhibit E,that, following the completion of mining, cause new <br /> evaporative depletions and new consumptive use from wetlands established as the result of <br /> reclamation. The foregoing excludes the "Peschel Pond"that was created due to mining <br /> operations occurring prior to December 31, 1980, with a surface area of approximately 7.2 acres, <br /> located in the SE'/ of Section 7, Township 2 North, Range 68 West, 6th P.M., Weld County, <br /> Colorado, as depicted on Exhibit E. <br /> B. Location. The Mine Permit Area consists of approximately 712 acres <br /> located in Sections 7, 8, 9, 17, & 18, Township 2 North, Range 68 West, 6th P.M., Weld County, <br /> Colorado, and is depicted on Exhibits A&E. <br /> C. Source. Water tributary to St. Vrain Creek and Dry Creek, a tributary of <br /> St. Vrain Creek. <br /> D. Date of appropriation. October 26, 2004,on which date there was a <br /> concurrence of intent to appropriate and overt acts in furtherance of such intent, including, <br /> 12 <br />
