Ruling and Decree <br /> Case No.2009CW271 <br /> City of Longmont <br /> 01CW188. <br /> viii. Replacement, augmentation and exchange water available from <br /> Longmont's interests in the Rough&Ready Ditch and the Oligarchy Ditch pursuant to decrees <br /> entered by the District Court in and for Water Division No. 1 on or about November 20, 2008 in <br /> Case Nos. 00CW240 and 241. <br /> ix. Replacement, augmentation and exchange water made available to <br /> Longmont by decrees to be entered by the District Court in and for Water Division No. 1 <br /> pursuant to change applications previously filed by Longmont involving Longmont's interests in <br /> the following ditches: James Ditch(Case No. 00CW239) and Peck Lateral Ditch(Case No. <br /> 07CW330),both diverting from St. Vrain Creek. <br /> x. Replacement, augmentation and exchange water to be made <br /> available from Longmont's interests in the following reservoirs diverting from St. Vrain Creek <br /> pursuant to decrees entered by the District Court in and for Water Division No. 1 in the following <br /> cases: Case No. 87CW235, Oligarchy Reservoir No. 1; Case No. 87CW231, Pleasant Valley <br /> Reservoir; Case No. 87CW222, Union Reservoir; Case No. 87CW253,McIntosh Reservoir; <br /> Case No. 87CW232, McCall Reservoir; and Case No. 87CW233, Clover Basin Reservoir. <br /> Replacement, augmentation and exchange water made available to Longmont pursuant to <br /> the decrees and from the sources described in this Paragraph 8.J. shall include reusable municipal <br /> return flows resulting from such sources and uses. The point of discharge of Longmont's <br /> wastewater treatment plant effluent is presently located in the SW%NE% of Section 11, <br /> Township 2 North, Range 69 West of the 6th P.M., Boulder County, Colorado. <br /> K. Dry-up. Longmont shall remove land from irrigation by the Longmont <br /> Coffm Davis Right in order to use the water right for the alternate uses. The percentage of the <br /> Longmont Coffm Davis Right available for the alternate uses shall be determined using the <br /> following equation: <br /> Alternate Use Percentage=(315.5 acres - Irrigated Acres)/315.5 acres x 100 <br /> For example, if Longmont continues to irrigate the two historically irrigated fields located <br /> outside the Mine Permit Area, as shown on Exhibit B, with an area totaling approximately 36 <br /> acres, then Longmont may use approximately 88.5 percent of the Longmont Coffin Davis Right <br /> for the alternate uses. Should Longmont elect to utilize a portion of the Longmont Coffm Davis <br /> Right for irrigation within Mine Permit Area the acreage to be irrigated would be included in the <br /> foregoing calculation,thereby reducing the amount that could be used for the alternate uses. <br /> L. Revegetation. The lands historically irrigated by the Longmont Coffin <br /> Davis Right that have been mined and are not covered by ponds and wetlands upon completion <br /> 11 <br />
