Review and comment on the cost estimate and Division's Financial Warranty proposed of <br /> $219,000 <br /> Operator requests a credit or reduction be considered on cost estimates and warranty where applicable for <br /> backfill, grading and topsoil placement that has been accomplished to date on approximately 30 acres of <br /> the area to be reclaimed. <br /> General Questions and Comments: <br /> 7. Address comments from the Colorado Division of Water Resources: <br /> As per the Colorado Division of Water Resources recommended conditions for approval, Operator and <br /> Applicant agree that the Cesar Pit reclamation plan will ensure water will not be retained onsite for more <br /> than 72 hours unless an augmentation plan approved by water court is obtained. Exposure of ground <br /> water will not occur during or after mining operations. If storm water is contained onsite, it must <br /> infiltrate into the ground or be released to the natural stream system within 72 hours, or all work must <br /> cease until a substitute water supply plan or augmentation plan is obtained. <br /> 8. Address comments from the State Historic Preservation Officer: <br /> In accordance with the February 1, 2016 letter from History Colorado,the Operator and Applicant agree <br /> that if human remains should be discovered during reclamation or mining of Cesar Pit, the requirements <br /> under State law C.R.S. 24-80 (part 13) apply and must be followed. <br /> 9. Address comments from Colorado Parks and Wildlife: <br /> In accordance with the February 27, 2016 letter from Colorado Parks and Wildlife,the Operator and <br /> Applicant agree that if nesting burrowing owls are present on the site,no human encroachment or surface <br /> disturbance will occur within 100 meters of nesting burrowing owls from March 1 to August 15 and that <br /> CPW guidelines will be followed if burrowing owls are noticed that merely occupy the site. In addition, <br /> as recommended, native plant species will be used to achieve proper reclamation and prevent erosion or <br /> habitat fragmentation. As new planting of native species establishes, weeds will be controlled including a <br /> through noxious weed control program. Generally, mowing frequently will be done to address weed <br /> control on all parts of the permitted area with a mower that shreds the weeds yet helps prevent covering <br /> the new grass seedlings too deeply with residue while maintaining good sunlight penetration for the cover <br /> crop and permanent native grasses to flourish. <br /> 10. Provide proof of the local newspaper publications required by Rule 1.6.5 <br /> Please find enclosed herewith the notarized statement from the Pueblo Chieftain newspaper, Pueblo, <br /> Colorado, as proof of the publication of public notice as required in Rule 1.6.5. <br /> 11. Provide proof of mailing or serving a copy of the public newspaper notice, to all owners of <br /> record of the surface and mineral rights of the affected land; and the owners of record of all land <br /> surface within 200 feet of the boundary of the affected lands, as required by Rule 1.6.2(1)(c): <br /> 4 <br />
