CCC proposes to discharge a very significant volume of water from dewatering wells (200- <br />300gpm during years 1-3; 100-200gpm during years 4-8; <100gpm after year 8); potentially in <br />the region of 3000 acre -ft over 8 years. <br />a. Please clarify the legal right of CCC to this groundwater. <br />CCC responded "Colowyo will be submitting a dewatering well/system applications to <br />the Colorado Division of Water Resources to install dewatering wells and remove <br />groundwater. As noted in the adequacy response to Item 1 in the November 20, 2015 <br />adequacy response letter, once any permit(s) are secured, if applicable, Colowyo will <br />update the PAP with the permits secured. Text has been inserted into Volume 15, Rule 2 <br />indicating this also." The text discussing CCC's plan has been added to Page 111. <br />This item will be resolved with the following stipulation: <br />Stipulation 19: DEWATERING WELL PERMITS MUST BE IN PLACE, AND THE PERMIT <br />APPLICATION PACKET UPDATED ACCORDINGLY, BEFORE ANY DISTURBANCE <br />ASSOCIATED WITH THE COLLOM PIT BOX CUT IS ALLOWED TO OCCUR. <br />CCC requested that the stipulation be re -worded. The requests improve the clarity of <br />the stipulation. The re -worded stipulation is as follows: <br />Stipulation 19: DEWATERING WELL PERMITS MUST BE IN PLACE, AND A MINOR <br />REVISION BE SUBMITTED AND APPROVED BY THE DIVISION TO UPDATE SECTION <br />2.03.10 OF VOLUME 1 OF THE PERMIT APPLICATION PACKAGE, BEFORE ANY <br />DISTURBANCE ASSOCIATED WITH THE COLLOM PIT BOX CUT IS ALLOWED TO OCCUR. <br />Please describe how the water will be used or discharged. (i.e. Where will it be pumped <br />to? What are the anticipated impacts to the receiving drainage?) <br />CCC responded "Language has been inserted into Volume 15, Rule 2 which indicates <br />how Colowyo will utilize and/or discharge the dewatering water. Anticipated impacts to <br />receiving streams have been included in Volume 15, Rule 2." CCC have stated, on Page <br />112, that they will discharge to Collom Gulch and the West Fork of Jubb Creek, with an <br />approved CDPHE permit. This item is resolved with the following stipulation: <br />Stipulation 20: A DISCHARGE PERMIT FOR WATER PUMPED FROM DEWATERING WELLS <br />MUST BE IN PLACE, AND THE PERMIT APPLICATION PACKET UPDATED ACCORDINGLY, <br />BEFORE ANY DISTURBANCE ASSOCIATED WITH THE COLLOM PIT BOX CUT IS ALLOWED <br />TO OCCUR. <br />
