STATE HIGHWAY ACCESS PERMIT #315161 December 22, 2015 <br />Located in Pitkin County on Hwy 131 B 13.223 Left <br />For Bowie Acquisition Group, LLC <br />from the traveled way or to the CDOT Right -of -Way. Where the hard surface is to abut the <br />existing pavement, the existing pavement shall be saw cut and removed a minimum of one <br />foot back from the existing edge for bituminous, or until an acceptable existing cross slope is <br />achieved. Surfacing shall meet the Department's specifications with minimum surfacing to be <br />equal to, or greater than, existing highway conditions. <br />13. The access shall be surfaced in accordance with Section 4.7 of the Access Code immediately <br />upon completion of earthwork construction and prior to use <br />14. A Notice to Proceed, CDOT Form 1265, is required before beginning construction on the <br />access or any activity within the highway Right -of -Way. To receive the Notice to <br />Proceed the Applicant shall submit a complete packet to CDOT with the following items: <br />(a) A cover letter requesting a Notice to Proceed, and the intended date to begin construction. <br />(b) Construction Plans (11"x 17" with a minimum scale of 1" = 50') by a Colorado Professional <br />Engineer in full compliance with the State Highway Access Code The plan shall provide: <br />i) Plan view with driveway dimensions - turn radius, width, slope, gates, etc. <br />ii) Typical road section - existing and proposed sub base, base, pavement, and shoulder <br />dimensions. <br />iii) Centerline profile of the access/Hwy connection showing depths, driveway slope, etc. <br />(c) Certificate of Insurance Liability as per Section 2.3(11)(i) of the State Highway Access <br />Code. <br />(d) A certified Traffic Control Plan in accordance with Section 2.4(6) of the Access Code. The <br />Traffic Control Plan shall provide accessibility features to accommodate all pedestrians <br />including persons with disabilities for all pathways during construction. <br />15. No drainage from this site shall enter onto the State Highway travel lanes. The Permittee is <br />required to maintain all drainage in excess of historical flows and time of concentration on site. <br />All existing drainage structures shall be extended, modified or upgraded, as applicable, to <br />accommodate all new construction and safety standards, in accordance with the Department's <br />standard specifications. <br />16. Open cuts, which are at least 4 inches in depth, within 30 feet of the edge of the State <br />Highway traveled way, will not be left open at night, on weekends, or on holidays, or shall be <br />protected with a suitable barrier per State and Federal Standards. <br />17. Nothing in this permit shall prohibit the Chief Engineer from exercising the right granted in CRS <br />43-3-102 Including but not limited to restricting left hand turns by construction of physical <br />medial separations. <br />18. The Permittee is responsible for obtaining any necessary additional Federal, State and/or <br />City/County permits or clearances required for construction of the access. Approval of this <br />access permit does not constitute verification of this action by the Permittee. Permittee is also <br />responsible for obtaining all necessary utility permits in addition to this access permit. <br />19. All workers within the State Highway right-of-way shall comply with their employer's safety and <br />health policies/procedures, and all applicable U.S. Occupational Safety and Health <br />Administration (OSHA) regulations - including, but not limited to the applicable sections of 29 <br />CFR Part 1910 - Occupational Safety and Health Standards and 29 CFR Part 1926 - Safety <br />and Health Regulations for Construction.
