STATE HIGHWAY ACCESS PERMIT #315161 December 22, 2015 <br />Located in Pitkin County on Hwy 131 B 13.223 Left <br />For Bowie Acquisition Group, LLC <br />TERMS AND CONDITIONS <br />1. This permitted access is only for the use and purpose stated in the Application and Permit. <br />This Permit is issued in accordance with the State Highway Access Code (2 CCR 601-1), and <br />is based in part upon the information submitted by the Permittee. Any subsequent relocation, <br />reconstruction, or modifications to the access or changes in the traffic volume or traffic nature <br />using the access shall be requested for by means of a new application. Any changes causing <br />non-compliance with the Access Code may render this permit void, requiring a new permit. <br />2. This permit replaces permit any and all additional access permits that may be in existence for <br />this access. <br />3. The traffic volume shall be 66 DHV. This is for coal operation. <br />4. The Permittee shall place a 2" overlay for the access approach as indicated in Exhibit A and <br />Huddleston -Berry (HBET) Report dated December 11, 2015. The overlay shall be completed <br />by September 30, 2016. <br />5. The Permittee shall maintain this section of roadway as outline in Exhibit A for the life of the <br />mine operation. <br />6. The Permittee shall provide a restoration plan to the Colorado Division of Reclamation Mining <br />and Safety for the reclamation cost to perform a 3" overlay when the mine becomes inactive. <br />This 3" overlay shall be done within 6 months of the mine closing. The restoration plan shall <br />be part of the Colorado Division of Reclamation Mining and Safety Permit #C1996083 <br />7. The Permittee shall provide a quarterly report showing the actual pavement condition by a <br />Colorado Registered Engineer on the asphalt condition of the highway. The report shall be <br />mailed to: <br />Colorado Department of Transportation <br />Region 3 Access Manager <br />222 South 6th Street, Room 100 <br />Grand Junction, CO 81501 <br />8. Based upon the HBET report and the exiting pavement conditions, the Permittee shall do <br />additional 2" overlays at the discretion of the Department for the life of the mining operation. <br />9. This access shall be constructed 24 feet wide with, at minimum, a 50' turning radii to <br />accommodate the minimum turning radius of the largest vehicle, or 35 foot, whichever is <br />greater. <br />10. The horizontal axis of the access to the State Highway shall be constructed perpendicular to <br />the centerline of the highway and extend a minimum distance of 40 feet, or to the property line, <br />from the edge of roadway, whichever is greater. (An angle between 90 and 60 degrees may be <br />acceptable only if significant physical constraints require a skew angle less than 90 degrees <br />and is approved by the issuing authority based on site specific conditions.) This design shall <br />be in conformance with section 4 of the State Highway Access Code, 2CCR 601-1. <br />11. Side slopes shall be at a 4:1 slope on the roadway. The roadway shall slope away from the <br />highway at a -2% grade for the first 20 feet of driveway. This design shall be in conformance <br />with section 4 of the State Highway Access Code, 2CCR 601-1. <br />12. The access shall be surfaced in accordance with Section 4.7 of the Access Code immediately <br />upon completion of earthwork construction and prior to use. This access shall be hard <br />surfaced in accordance with Section 4.7 of the Access Code a minimum distance of 50 feet <br />
