FINDINGS OF THE STATE ENGINEER <br />IN THE MATTER OF AN APPLICATION FOR A PERMIT TO CONSTRUCT A WELL (GRAVEL PIT) <br />IN WATER DIVISION NO. 1, MORGAN COUNTY, COLORADO <br />APPLICANT: BUILDER'S AGGREGATE CO., INC. <br />FILE NO.: AD- 1308R..) <br />In compliance with C.R.S. 37-90-137(1), Builder's Aggregate Co., Inc., 915 W. Beaver Ave., <br />Fort Morgan, Colorado 80701, (hereinafter "applicant") submitted an application for a permit to <br />construct and reactivate a pre -January 1, 1981 gravel pit. Based on information provided by the <br />applicant and records of the Division of Water Resources, the State Engineer finds as follows: <br />1. The application was received complete by the State Engineer on February 4, 1993. <br />2. The proposed gravel pit will be located in the S1/2 of the NW1/4 of Section 31, Township 4 <br />North, Range 58 West, 6th Principal Meridian. <br />3. The proposed location is outside the boundaries of a designated ground water basin. <br />4. The applicant proposes to expose 4.57 surface acres of water in the gravel pit. This situation <br />will cause evaporative losses from the pond. Additional beneficial uses causing losses may <br />include stream carriage losses, water hauled off in the product, dust suppression, and <br />washing the sand and gravel. <br />5. At the proposed depth of 30 feet, the pit will expose ground water and be hydraulically <br />connected to Bijou Creek which is a tributary of the South Platte River System. Diversion of <br />ground water by the gravel pit will influence the rate or direction of movement of water in <br />those natural streams and their alluvium. <br />6. Bijou Creek and the South Platte River System are overappropriated. At some or all times <br />of the year, the water supplies of said stream systems are insufficient to satisfy all the <br />decreed water rights senior to an appropriation by the applicant. <br />7. The inadvertent and unavoidable losses from the subject gravel pit pond and the associated <br />operation would cause depletion to Bijou Creek and the South Platte River System at times <br />when these streams are overappropriated. <br />8. Records show that there are senior vested water rights withdrawing ground water from the <br />alluvium of Bijou Creek and the South Platte River. The applicant's proposed use would <br />decrease the amount of ground water in the alluvium of said streams. <br />9. The boundaries of the proposed gravel pit may be located less than 600 feet from an existing <br />well, permit no. 8630-R. <br />10. No plan for augmentation to remedy the injury to vested water rights has been approved by <br />the Division 1 Water Court. <br />11. A substitute water supply plan providing augmentation to remedy the injury to vested water <br />rights has not been approved by the State Engineer. <br />
