Mr. Woolridge
Page 12
March 14, 2016
5. The Applicant is proposing an alternate Reclamation Plan which includes constructing a
series of fish hatchery ponds at the east half of the property. The current post -mining land use
of the site is developed water resource. Developing the site to include fish hatchery ponds
would be considered a change in the post -mining land use. Specifically, the post -mining land
use would need to be changed to include a commercial/industrial use. Any change to the
permit which has a significant effect upon the approved Reclamation Plan will require an
Amendment. The Applicant may either withdraw the alternate Reclamation Plan from further
consideration or they may submit an Amendment Application to address the proposed
changes. Please respond.
This concludes the Division's preliminary adequacy review of this Technical Revision. Please
remember that the decision date for this Technical Revision is March 31, 2016. As previously
mentioned, if you are unable to provide satisfactory responses to any inadequacies prior to this
date, it will be your responsibility to request an extension of time to allow for continued
review of this Technical Revision. If there are still unresolved issues when the decision date
arrives and no extension has been requested, the Technical Revision will be denied.
If you have any questions, please contact me at (303)866-3567 x8116.
Sincerely,
Michael A.
