Mr. Lees <br />Page I 2 <br />March 11, 2016 <br />5. The Applicant has indicated the improved road will not be reclaimed. The road may remain <br />in the improved state if the Applicant provides the Division with a signed and notarized letter <br />from the landowner which authorizes the access road to remain. Otherwise, the Applicant <br />must describe how the access road will be reclaimed. <br />6. The Applicant has stated that waste rock from the development of the portal will be crushed <br />and used by Park County or the Town of Alma. This activity is considered to be mining as <br />defined by the Hard Rock, Metal and Designated Mining Operation Rules. The Applicant <br />may remove this portion of the plan from consideration, or the Applicant may withdraw the <br />NOI application and submit a Reclamation Permit for a mining operation. Please respond. <br />7. Please specify if the estimate of the amount of material to be moved is in cubic yards or tons <br />(the Division is aware of the limitation when entering this information on the fillable forms). <br />8. The Applicant has stated that fuel will be stored in a steel container. Please specify the <br />volume of fuel to be stored and confirm that the secondary containment can hold 110% of the <br />volume of fuel to be stored onsite. <br />9. Describe the sampling techniques which will be used to determine if there is a viable <br />rhodochrosite deposit within the mine. Are sampling techniques based on visual observation? <br />The Applicant should be aware that removal of rhodochrosite from the mine may not be done <br />under an NOI. If the Applicant discovers a deposit of rhodochrosite and wishes to remove the <br />mineral specimen(s), it will require the submittal and approval of a Reclamation Permit. <br />Please respond. <br />10. Please provide a detailed description of the existing portal. Has the portal been backfilled? If <br />so, specify the approximate volume of the backfill material. What are the dimensions of the <br />existing portal? The Applicant may submit photographs to illustrate the existing conditions at <br />the site. <br />11. Please describe how the portal will be safeguarded from unauthorized entry while <br />prospecting is being conducted. In addition, specify how the portal will be safeguarded <br />during periods of inactivity in the winter months. <br />12. The Applicant has identified a waste rock crushing and storage area immediately above <br />Buckskin Gulch. Please provide detailed description of the stormwater controls which will <br />employed to ensure that no sediment leaves this area. (see additional comments under Item <br />No. 6) <br />13. The Applicant has indicated the portal will be advanced through drilling and blasting. Please <br />specify if any blasting at the surface will be required. If so, the Division may require a <br />detailed blasting plan. If blasting will be contained underground, then specify the distance <br />from the portal to first point where blasting will occur. <br />
