No further action is required on this item until item 73 has been <br />satisfactorily resolved. <br />b. Please provide references in the text to supporting data. <br />The response is sufficient. <br />c. Please propose a monitoring point(s) that will allow the prediction of "no impact" to the <br />Trout Creek Sandstone to be verified. <br />CCC proposed drilling a new monitoring well into the Trout Creek Sandstone, north to <br />northeast of the middle of the northern edge of the Collom pit, (Volume 15, Rule 4, <br />Page 11). CCC have proposed to monitor field parameters quarterly, and a full suite of <br />water quality parameters annually. Such a well will provide a better baseline <br />characterization of the Trout Creek Sandstone aquifer, and should allow the <br />predictions made in the probable hydrologic consequences discussion to be verified. <br />In the interests of expediency this item will be resolved with the following stipulation: <br />Stipulation 18: COLOWYO COAL COMPANY WILL CONSTRUCT A GROUNDWATER <br />MONITORING WELL COMPLETED IN THE TROUT CREEK SANDSTONE, AND CARRY OUT <br />STANDARD WELL TESTS TO ESTIMATE AQUIFER PROPERTIES. FOLLOWING <br />COMPLETION OF THE WORK, A MINOR REVISION WILL BE SUBMITTED TO UPDATE THE <br />PERMIT APPLICATION PACKAGE WITH A COMPLETE DESCRIPTION OF THE WELL, AND <br />TO UPDATE TABLES 2.04.7-38,-39,-40 AND -41. MAPS 10B AND 11C WILL ALSO BE <br />UPDATED. THESE ACTIONS SHOULD BE COMPLETED BEFORE THE END OF CALENDAR <br />YEAR 2016, OR BEFORE ANY DISTURBANCE ASSOCIATED WITH THE COLLOM PIT BOX <br />CUT IS ALLOWED TO OCCUR, WHICHEVER IS SOONER. <br />81. CCC proposes to discharge a very significant volume of water from dewatering wells (200- <br />300gpm during years 1-3; 100-200gpm during years 4-8; <100gpm after year 8); potentially in <br />the region of 3000 acre -ft over 8 years. <br />a. Please clarify the legal right of CCC to this groundwater. <br />CCC responded "Colowyo will be submitting a dewatering well/system applications to <br />the Colorado Division of Water Resources to install dewatering wells and remove <br />groundwater.
