SECTION III - REQUESTED REVISIONS OF PERMIT APPLICATION and MIDTERM ADEQUACY <br />QUESTIONS <br />As a result of this midterm review, for the purpose of fulfilling the requirements of the Colorado Surface Coal <br />Mining Reclamation Act, and the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining, <br />pursuant to Rule 2.08.3, the Division finds that the permit application C-1981-044 contains the below bulleted <br />deficiencies. The Division requests that the permittee correct the deficiencies by submission of revised permit pages <br />under appropriate revision applications, by June 30, 2016. <br />2.03.4 Identification of Interest <br />The Division has received a Minor Revision (MR55) which updates the identification of interests in association <br />with the ownership of the mine. Please ensure the following are up to date. <br />1. In accordance with Rule 2.03.4(3)(a), for each person (officer and director of the entities) who owns or <br />controls the applicant, please provide their address, social security number (optional) and employer <br />identification number. <br />2. The information required by Rule 2.03.4(3)(d) and (e) will need to be provided. For each person who is the <br />owner and controller of the applicant, please supply all the information required under this rule for all <br />owned or previously owned or controlled surface coal mining and reclamation operation in the United States <br />within the five years preceding the date of the application. <br />3. Please update Exhibits 42 or 42a with any ownership changes. <br />Rule 2.03.9 — Personal Injury and Property Damage Insurance Information <br />4. The operator will need to supply an updated copy of a certificate of liability insurance if or when ownership <br />changes, meeting the requirements of Rule 2.03.9. <br />2.04.7 Baseline Hydrologic Conditions <br />This section of the rules is adequately addressed in the permit. Should mining recommence at some point in the <br />future, baseline hydrologic data encompassing (more recent information) the years up to that date should be <br />evaluated. <br />2.04.8 Baseline Climatological Information <br />This section of the rules is adequately addressed in the permit.
