5/3/2013 <br />The Division sent MCM its preliminary adequacy review of the RN6 <br />application. <br />7/26/2013 <br />MCM submitted a response to the preliminary adequacy review for RN6. <br />9/4/2013 <br />The Division sent MCM a second adequacy review letter for RN6. <br />9/4/2013 <br />The Division sent MCM a third adequacy review letter and an updated <br />reclamation cost estimate for RN6. <br />5/2/2014 <br />MCM submitted Technical Revision No. 36 (TR36) to address the <br />second and third adequacy review items for RN6. <br />5/12/2014 <br />TR36 was deemed complete for review by the Division. <br />6/11/2014 <br />The Division sent MCM a preliminary adequacy review for TR36. <br />7/16/2014 <br />MCM submitted a response to the Division's preliminary adequacy <br />review. <br />8/6/2014 <br />The Division sent MCM a second adequacy review letter for TR36. <br />8/7/2014 <br />The Division sent MCM a third adequacy review letter for TR36 with an <br />updated reclamation cost estimate. <br />10/01/2014 <br />MCM submitted a response to the Division's second and third adequacy <br />review letter. <br />10/6/2014 <br />The Division sent MCM a fourth adequacy review letter for TR36. <br />10/21/2014 <br />MCM submitted a response to the Division's fourth adequacy review <br />letter. <br />10/31/2014 <br />The Division issued a proposed decision to approve TR36. <br />Since the approval of RN6, the operator updated Surface and Coal Ownership with MR51, and changed their Officer <br />and Director information twice, the first time through MR52 in March of 2015 and again with MR53 in July 2015. <br />Some solid waste was removed from the site in September 2015, and documented in the permit with MR 54 <br />approved in October 2015. MR55 was submitted to the Division in January 2016 to change the Parent Company <br />from Peabody Energy Corporation to Bowie Colorado Operations, LLC. At the time of this mid-term review, this <br />revision has not yet been approved. <br />The mine site entered temporary cessation status initially when mining ceased in 1995. The mine was subsequently <br />returned to active status as a result of limited reclamation activities at the site that occurred during the period of <br />2008 to 2010. On June 26, 2013, MCM submitted a request to the Division to return to temporary cessation status. <br />According to MCM, they do not anticipate completing any significant additional site reclamation activities in the <br />foreseeable future. Also, they indicated that given the market conditions for coal, they do not anticipate reopening <br />the mine in the foreseeable future. The Division subsequently approved the request and on July 9, 2013, the <br />operation was placed back into temporary cessation status. <br />Violations <br />No violations have been issues since the last permit review. <br />Permit Stipulations <br />There are no active stipulations on the Williams Fork Mines permit. <br />C1981044 Midterm 2016 Findings.docx Page 5 <br />
