the LOM permit area to 22,694 acres. Extraction of 10,000,000 tons/year was approved under
<br />Technical Revision No. 28, in 1997.
<br />Permit Revision No. 4 (PR -04), Eastern Mining District (southern area), was approved April 20,
<br />1998. The revision approved continuation and expansion of mining in the southern portion of
<br />the EMD in portions of sections 21, 22, 23, 24, 27, 28, and 29 T5N R86W.
<br />Permit Revision No. 5 (PR -05) was approved on June 28, 2000 and provided for extension of
<br />mining into the Northern Mining District in portions of the following Sections in TSN, R86W: 8,
<br />9, 10, 11, 12, 13, 14, 15, 16, 17, 20, 21, and 22. The mine expansion area undermined and
<br />subsided portions of Fish Creek and its associated alluvial valley floor in sections 16, 15, 10 and
<br />11.
<br />Permit Revision No. 6 (PR -06) was approved on May 21, 2004. Permit Revision No. 6 provided
<br />for continued mining in the Northern Mining District in Sections 3, 4, 7, 8, 9, 10, 11, 16, and 17
<br />in TSN, R86W.
<br />Permit Revision No. 7 (PR -07) was approved on January 2, 2007, and allowed for continued
<br />longwall and development mining in the Northern Mining District in sections 4, 5, 6, 7, and 8 of
<br />TSN, R86W, and development mining in the Western Mining District into portions of Section 17
<br />and 18, TSN, R86W, and Section 13 TSN, R87W.
<br />Permit Revision No. 8 (PR -08) was approved on October 30, 2009, and allowed for the
<br />expansion of mining in the Western Mining District with development and longwall mining in
<br />Sections 17, 18, 19, and 20 of TSN, R86W, and 13, 22, 23, 24, 25, 26, and 27 of TSN, R87W.
<br />PR -08 approved mining of longwall panels 12L, 13L, 14L, 15L, 16L, and 17L, and gateroads
<br />12L, 13L, 14L, 15L, 16L, 17L, 18L. A portion of Fish Creek was undermined by longwall
<br />panels 12L, 13L, 14L, 15L, and associated gateroads. Routt County Road No. 27 is to be
<br />undermined by longwall panels 13L, 14L, 15L, 16L, and 17L. Coal production is not approved
<br />to increase beyond the rate of 12,000,000 tons per year.
<br />Permit Revision No.9 (PR -09) was submitted on August 7, 2012, and proposed to modify the
<br />approved Foidel Creek Mine plan for the Western Mining District (WMD). PR -09 proposed to
<br />add an additional longwall panel, the 11 -Left Panel, and to include an extension of the 12 -Left
<br />and 13 -Left Panels. The additional panel, and panel extensions to the west, would have required
<br />modification of the currently approved Foidel Creek Mine Permit Area boundary, adding
<br />approximately 560 acres to the Mine Permit Area. Due to potentially unstable mining conditions
<br />in the PR -09 area, TC requested to withdraw PR -09. The withdrawal request was approved by
<br />the Division on June 12, 2013.
<br />Permit Revision No. 10 (PR -10) was submitted on January 8, 2015. At the writing of this
<br />document, the PR -10 application is still under review by the Division. Overall, the PR -11
<br />application mirrors the PR -10 application with one exception. PR -10 proposes to mine coal in
<br />the Wolf Creek Seam in the COC -54608 Coal Lease Area located in Section 21 and 22 of
<br />Township 5 North, Range 86 West. At this time TC does not have the right to mine coal in this
<br />portion of the mine area. TC has applied for a Lease -By -Modification (LBM) in order to gain
