Please update the Fish and Wildlife <br />Plan to discuss how future mining, reclamation and site maintenance operations will <br />minimize disturbances and adverse impacts to fish and wildlife species. Please review Rule <br />4.18(5) to help formulate a wildlife protection plan. <br />According to the fish and wildlife plan, no rare or endangered species were observed within <br />the permit area during the collection of baseline wildlife resource information. However, the <br />potential exists for threatened and endangered species to be exist and/or occur within the <br />permit and affected area. Section 2.04.11 of the permit discusses the species that may exist <br />within the permit area. The fish and wildlife plan discusses the protection of raptors and the <br />procedure that will be followed should threatened and endangered species be observed at the <br />site. However the plan does not discuss potential impact control measures and management <br />techniques that will be utilized for future mining, reclamation and site maintenance <br />operations to protect the threatened and endangered species that may exist and/or occur <br />within the permit area in accordance with Rule 2.05.6(2)(a)(iii)(A). For each of the <br />threatened and endangered species listed in Section 2.04.11 of the permit that may exist <br />and/or occur within the permit area, please provide an plan that discusses impact control <br />measures and management techniques that will be utilized. <br />2.05.6(6) Subsidence Survey, Subsidence Monitoring, and Subsidence Control Plan <br />The following adequacy review items were noted: <br />Please update Map 925 to depict and or label the following structures and renewable <br />resources: oil pipeline, County Road 107, Irrigation Ditches, Yampa River and Williams Fork <br />River. <br />Page 2.05-52 indicates that three private residences are located within the permit area but are <br />outside of the planned mining area. Based on a review of Map 25 and Map 24 one private <br />residence is located within the proposed longwall panel north of the 10"' East Gate Road. <br />Please update this section of the permit to indicate this. In accordance with Rule 2.05.6(6)(b) <br />please update this section of the permit to indicate the worst possible consequences which <br />subsidence, if it occurred, could have for this structure. Also please update the subsidence <br />control plan for the private residence to address the applicable requirements of Rule <br />2.05.6(6)(f). <br />2.06.4 — Steep Slope Minim <br />No adequacy issues noted. <br />2.06.5 —Variances from Approximate Original Contour Restoration Requirement For Steep Slope <br />Minin <br />No adequacy issues noted <br />4.03.1(7), 4.03.2(7) and 4.03.3(7) — Haul Road, Access Road and Light Use Road Reclamation <br />
