" <br />Applicant's Response: <br />The applicant will use the "Seed Mix No. 2 — Saturated Areas around Ponds and Open <br />Water" for reclamation of proposed wetland areas. Please disregard the above named <br />list included as an attachment to the Adequacy Review Response dated August 2009. <br />Also, please see the revised Reclamation Plan map -Exhibit F (sheet 7 of 7) which <br />identifies the areas to be seeded with the respective seed mixtures. <br />7. "For item # 17, Please commit to submitting the inert fill signed affidavit and <br />obtaining the Divisions approval prior to importing any backfill material into the <br />permit area." <br />Applicant's Response: <br />Item 17 of the Division's May 14th letter states as follows: <br />"According to Exhibit L, in item 6 it states that 255,000 cubic yards of material will be <br />imported to backfill the area east of the relocated McCanne Ditch. Since this material <br />will not be generated at the site, the operator must provide a signed affidavit certifying <br />that the material is clean and inert as defined in Rule 1.1 (20). Also please provide a <br />general engineering plan stating how this imported material will be placed and <br />stabilized in a manner to avoid unacceptable settling and voids. " <br />The Applicant has since decided to use only on-site material for backfill and will not <br />impo an fill material as described in ItemTT above. Therefore, the Applicant <br />withdraws its August 2009 Adequacy Review ' esponse to Item 17 including the <br />proposed "general engineering plan" related to the placement of imported fill material. <br />EXHIBIT F <br />8. "In regard to Item# 19, the proposed final land use for Cell No. 2 and the expansion <br />area is not labeled on the reclamation plan map. According to the reclamation plan, <br />the proposed land use for Cell No. 2 should be wildlife habitat. Originally, the <br />proposed land use for the expansion area was cropland and pasture, but it appears <br />this area has changed to wildlife habitat. Please label the Reclamation Plan Map <br />accordingly." <br />Applicant's Response: <br />The Reclamation Plan map has been revised accordingly. Please see revised Exhibit F <br />(sheet 7 of 7) included with this adequacy review response. <br />10/2/2009 3 <br />
