Applicant's Response: <br />The Applicant currently has a Substitute Water Supply Plan (SWSP) and well permit <br />for the Bromley Lakes Pit (see attached). The current SWSP will be amended to <br />include new mining areas described in the Bromley Lakes permit amendment. No <br />ground water will be exposed until the existing SWSP has been amended. (See <br />attachment number 7) <br />9. "The mining plan map that was submitted will also need to be signed by the registered <br />land surveyor, professional engineer or qualified person who prepared it." <br />Applicant's Response: <br />See revised Mine Plan drawing (Exhibit D) attached. <br />6.4.4 EXHIBIT E — Reclamation Plan <br />10. "Since Cell #2 and Phase 18 will remain an unsealed open lake, prior to the release of <br />the site, you will need to obtain a court approved augmentation plan to replace the <br />depletions that result from long-term evaporation. In order to ensure that an <br />augmentation plan is obtained prior to site release please commit to filing an <br />application for an augmentation plan three years prior to the completion of mining." <br />Applicant's Response: <br />It is the Applicant's intent to not leave any open water surfaces in Cell 2 once <br />reclamation of this cell is completed. <br />The Applicant is aware that a court approved permanent plan of augmentation is <br />required prior to the release of the Bromley Lakes reclamation surety by the Division <br />and RMCC commits to filing a permanent plan of augmentation with the water court <br />at the appropriate time. Typically, such a plan would be filed once all reclamation <br />work has been completed and the actual ground water depletions have been quantified. <br />Therefore, it would bepremature togo to the time and exmnse of preparing a plan of <br />augmentation and filing same with the water court three years prior to the completion <br />of mining. <br />11. "It appears that you will plant Crested Wheatgrass on the excess Topsoil and <br />Overburden stockpiles...Is there another seed mixture that could be planted on these <br />stockpiles in lieu of Crested Wheatgrass that contains native grass species?" <br />Applicant's Response: <br />Please see the proposed topsoil/overburden stockpile seed mix at attachment number <br />1. <br />8/19/2009 4 <br />
