Dick Wolfe <br />July I, 2009 <br />D. 7 <br />iagc�. <br />required that RMCC obtain a well permit for the pit. A well permit was requested and assigned a <br />receipt number of 3600747. The State requested that we obtain waivers from well owners within <br />600 feet of the pit. In March 2008, we sent letters and waiver forms to the four well owners <br />within 600 feet, requesting that they waive any objection to the issuance of a well permit for the <br />Bromley Lakes Pit. The City of Brighton was the only well owner that returned a signed waiver <br />(attached). We never received a response from the other three well owners. We understand that <br />the State may hold a hearing in order for a permit to be issued without the waivers. <br />This renewal request is proposing generally the same operations as the previous request. RMCC <br />switched their mining operations to Erger's Pit in August 2008 and will remain in Erger's for <br />several years. RMCC stopped dewatering Cell 3 of the Bromley Lakes Pit in July 2008, causing <br />the total exposed groundwater within the pit to reach a maximum of 44 acres. Cell 2 continues to <br />be used as the water supply for dust suppression water use. These and the evaporative depletions <br />off of the exposed groundwater will be replaced by Fulton shares, water stored in Kenneth <br />Mitchell Lake, and a lease with the City of Brighton. <br />DEPLETIONS <br />The projected depletions at the pit for the period of this SWSP (August 2009 through July 2010) <br />are given in Table lA and consist of 117.3 acre-feet of net evaporation from the exposed water <br />surface (Column [6]) and 2.0 acre-feet of water used for dust control (Column [7]). These <br />depletions total 119.3 acre-feet of consumptive use at the site for the period of the SWSP <br />(Column [8]). The lagging of these depletions and out -of -priority depletions which occurred <br />during previous SWSPs total 111.9 acre-feet (Table 1B, Column [9]). The lagging methodology <br />was explained in the December 18, 2006 SWSP request. <br />REPLACEMENT SOURCES <br />Fulton Ditch Shares <br />RMCC owns a total of 70 Fulton Ditch shares. RMCC proposes to replace the depletions from <br />the Bromley Lakes site with 25 of these shares in the Fulton Ditch. The remaining 45 Fulton <br />Ditch shares will be used to replace depletions caused by the North Tower Pit and Ready Mixed <br />Pit 1. All of the Fulton Ditch shares will be jointly operated. If, at any time, there are extra <br />Fulton credits at one pit and remaining depletions at another pit, the extra credits will be used to <br />replace depletions. All the shares will be delivered down the lateral that historically served the <br />Bromley Lakes Site and will be measured prior to their storage in Kenneth Mitchell Lake and/or <br />their release to the river for replacement of depletions. RMCC has an agreement with the City of <br />Brighton to allow for up to 200 acre-feet of RMCC storage in Kenneth Mitchell Lake. As in the <br />previous SWSP an annual consumptive use credit of 1.76 acre-feet per share is claimed, yielding <br />44.0 acre-feet of replacement water per year for 25 shares.
