"For the Arends parcel, a statement by the landowner entitled "Unanimous Written Consent Concerning the Legal Right to Enter Made by the Members of Aggregate Investments LLC and the Partners of Sprat -Platte Ranch Co., LLP" was submitted as a source of legal right to enter. Dale J. and Bonnie L. Reinoehl are the Grantors and Ready Mixed Concrete Company is the Grantee on a Warranty Deed recorded with the Adams County Clerk and Recorder on April 20, 2001 at reception number 2001030793157 (see attachment number 10). 6.4.19 EXHIBIT S — Permanent Man -Made Structures 32. "There are numerous structures on and within 200 feet of the proposed permit area as listed in this exhibit. In accordance with Rule 6.4.19, when mining operations will (emphasis added) adversely affect the stability of any significant, valuable and permanent man-made structure located within 200 feet of the affected area, the applicant may either: a.)Provide a notarizes agreement between the applicant and the person(s) having an interest in the structure, that the applicant is to provide compensation for any damage to the structure; or b.)Where such an agreement cannot be reached, the applicant shall provide an appropriate engineering evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining operation. 8/19/2009 15
