6.4.14 EXHIBIT N — Source of Legal Right to Enter <br />30. "For the Arends parcel, a statement by the landowner entitled "Unanimous Written <br />Consent Concerning the Legal Right to Enter Made by the Members of Aggregate <br />Investments LLC and the Partners of Sprat -Platte Ranch Co., LLP" was submitted as a <br />source of legal right to enter. In accordance with Rule 6.4.14 this agreement must be <br />acknowledged by a Notary Public" <br />Applicant's Response: <br />Please see attachment number 11 for a notarized copy of the above referenced <br />statement. <br />31. "Please submit a source of legal right to enter for the remaining parcels in the <br />expansion area... <br />Applicant's Response: <br />Joseph R. and Ann M. Archuleta are the Grantors and Ready Mixed Concrete <br />Company is the Grantee on a Warranty Deed recorded with the Adams County Clerk <br />and Recorder on June 19, 2007 at reception number 2007000059212 (see attachment <br />number 9). <br />Dale J. and Bonnie L. Reinoehl are the Grantors and Ready Mixed Concrete Company <br />is the Grantee on a Warranty Deed recorded with the Adams County Clerk and <br />Recorder on April 20, 2001 at reception number 2001030793157 (see attachment <br />number 10). <br />6.4.19 EXHIBIT S — Permanent Man -Made Structures <br />32. "There are numerous structures on and within 200 feet of the proposed permit area as <br />listed in this exhibit. In accordance with Rule 6.4.19, when mining operations will <br />(emphasis added) adversely affect the stability of any significant, valuable and <br />permanent man-made structure located within 200 feet of the affected area, the <br />applicant may either: <br />a.)Provide a notarizes agreement between the applicant and the person(s) having an <br />interest in the structure, that the applicant is to provide compensation for any damage to <br />the structure; or <br />b.)Where such an agreement cannot be reached, the applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. <br />8/19/2009 15 <br />
