6.4.12 EXHIBIT L — Reclamation Costs <br />28. "This section is still under review. Some information is needed in response to this <br />adequacy review to conduct the cost estimate." <br />Applicant's Response: <br />The Applicant has prepared the following information requested by the Division <br />related to the current reclamation status of Bromley Lakes. <br />1. Maximum topsoil and overburden haul distance during reclamation is <br />estimated to be 'A mile. <br />2. Current status of existing pit slopes: <br />• Cell # 2- The north half of Cell 2 is currently used for wash fines <br />disposal. As a result, pit slopes are minor. After the northern portion of <br />Cell 2 has been filled the operator will begin filling the south portion of <br />the Cell with wash fines. If there are not enough wash fines to backfill <br />the south portion of Cell 2 the remaining portion of the pit will be <br />backfilled with on site excess overburden. <br />• Cell # 3- Currently, approximately 6,000 linear feet of the pit perimeter <br />is unreclaimed. The pit highwall is approximately 30 feet. During <br />reclamation pit slopes will be back filled to 3:1 and the top 10 feet of <br />the slope will be covered with topsoil. <br />• Pit #1- Pit 1 will be incorporated into Cell 3 during final reclamation of <br />the Cell. Currently, the south and west sides of Pit 1 have been <br />backfilled, graded and seeded. <br />3. To date, the Applicant has topsoiled the south and west sides of Pit #1. The <br />balance of the Bromley Lakes Pit will be topsoiled once all mining activities <br />have been completed. <br />The Applicant is prepared to assist the Division in the preparation of reclamation cost <br />estimates for Bromley Lakes including the additional areas to be mined as a result of <br />permit Amendment 002. <br />6.4.13 EXHIBIT M — Other Permits and Licenses <br />29. "Please include a substitute water supply plan and a well permit from the Division of <br />Water Resources in the list of other permits and licenses that will need to be obtained. " <br />Applicant's Response: <br />Included with this Adequacy Response is a copy of the Applicant's SWSP Renewal <br />Request, dated July 1, 2009, to the State Engineers Office for a SWSP. <br />8/19/2009 14 <br />
