• <br />Applicant's Response: <br />Because the City of Brighton intends to develop Bromley Lakes for parks and <br />recreation the Applicant has decided to withdraw planting of all trees and shrubs from <br />the reclamation plan. <br />17. "According to Exhibit L, in item 6 it states that 255,000 cubic yards of material will be <br />imported to backfill the area east of the relocated McCanne Ditch. Since this material <br />will not be generated at the site, the operator must provide a signed affidavit certifying <br />that the material is clean and inert as defined in Rule 1.1 (20). Also please provide a <br />general engineering plan stating how this imported material will be placed and <br />stabilized in a manner to avoid unacceptable settling and voids." <br />Applicant's Response: <br />The operator agrees to provide the Division with a signed affidavit certifying that all <br />imported backfill material is clean and inert as defined in Rule 1.1 (20). <br />RMCC will use the following plan related to the placement of all backfilled material. <br />• Place imported fill in one (1) foot lifts and compact to 95% Standard Proctor <br />compaction; <br />• During periods when fill is imported and compacted density measurements will <br />be taken on a weekly basis and the results reported to the DRMS monthly and, <br />• RMCC will provide the DRMS with a copy of the final quality assurance <br />report. <br />6.4.6 EXHIBIT F- Reclamation Plan Map <br />18. "It appears that Third Creek will be relocated during the mining and reclamation <br />process. The reclamation Plan Map displays the proposed location of where the creek <br />will be relocated however it displays the creek running through the water storage <br />reservoir instead of the berm between existing Cell No. 2 and No. 3 as described in the <br />reclamation plan. Please clarify. <br />Applicant's Response: <br />The Applicant does not intend to relocate Third Creek. The Reclamation Plan drawing <br />has been revised accordingly (see attachment number 5). <br />19. "For the Bromley Lakes Cell No. 2 parcel and the area east of the relocated McCanne <br />Ditch, please label the proposed land use for these portions of the effected areas." <br />8/19/2009 8 <br />
