Partners Combined SWSP Page 5 of 6 <br /> January 27, 2016 <br /> 7. Approval of this SWSP is for the purposes as stated herein. Any additional uses of this water <br /> must first be approved by this office. Any future historic consumptive use credits sought <br /> for this site (e.g., agricultural water transfer) must consider all previous credits applied. <br /> 8. All releases of replacement water must be sufficient to cover all out-of-priority depletions <br /> in time, place, and amount and must be made under the direction and/or the approval of <br /> the water commissioner. The release of replacement water may be aggregated to <br /> maximize beneficial use. The water commissioner and/or the division engineer shall <br /> determine the rate and timing of an aggregated release. <br /> 9. The replacement water that is the subject of this SWSP cannot be sold or leased to <br /> any other entity. As a condition of subsequent renewals of this SWSP, the <br /> replacement water must be appurtenant to this site until a plan for augmentation is <br /> obtained. A copy of this approval letter should be recorded with the county clerk and <br /> recorder. All replacement water must be concurrent with depletions in quantity, <br /> timing and locations. <br /> 10. Applicant shall replace the net evaporative depletions from the exposed ground <br /> water surface area for any time that the exposed ground water in the pit is not <br /> completely covered by ice. <br /> 11. The name, address, and phone number of the contact person who will be responsible <br /> for the operation and accounting of this plan must be provided on the accounting forms <br /> submitted to the division engineer and the water commissioner. <br /> 12. Adequate accounting of depletions and replacements must be provided to the <br /> division engineer in Greeley (divlaccounting@state.co.us) and the water <br /> commissioner (Mark Simpson, Mark.Simpson@state.co.us) on a monthly basis. <br /> Submitted accounting shall conform to the Administration Protocol "Augmentation <br /> Plan Accounting, Division One - South Platte River" (attached). All amounts shall be <br /> in acre-feet. <br /> In addition, the Applicant shall verify that the entities providing replacement water <br /> for this plan have included and shown this use in their monthly accounting submitted <br /> to this office. For this plan those entities are the City of Greeley (WDID 0303330) <br /> and the East Larimer County Water District (WDID 0302563). <br /> 13. This SWSP may be revoked or modified at any time should it be determined that <br /> injury to other vested water rights has or will occur as a result of this SWSP. Should <br /> this SWSP expire without renewal or be revoked prior to adjudication of a permanent <br /> plan for augmentation, all uses of water at the pit must cease immediately. <br /> 14. The approval of this SWSP does not relieve the Applicant and/or the landowner of the <br /> requirement to obtain a water court decree approving a permanent plan for <br /> augmentation or mitigation to ensure the permanent replacement of all depletions, <br /> including long-term evaporation losses and lagged depletions after gravel mining has <br /> ceased. Granting of this SWSP does not imply approval by this office of any such <br /> court application(s). <br /> 15. In accordance with amendments to §25-8-202(7), C.R.S., and "Senate Bill 89-181 <br /> Rules and Regulations" adopted on February 4, 1992, the State Engineer shall <br /> determine whether the substitute supply is of a quality to meet requirements of use <br /> to senior appropriators. As such, water quality data or analysis may be requested at <br /> any time to determine if the water quality is appropriate for downstream water <br /> users. <br />
