Partners Combined SWSP Page 4 of 6 <br /> January 27, 2016 <br /> and Treiber Lake A have been approved by this office. Kyger Reservoir is filled with water diverted <br /> from the Cache la Poudre River via the New Mercer Ditch, Larimer County Canal No. 2, the Overland <br /> Trail Diversion Structure, Munroe Gravity Canal (a/k/a North Poudre Supply Canal), and/or the <br /> Pleasant Valley Pipeline. The total decreed capacity of the Overland Trail Reservoirs is 10,962 acre- <br /> feet, conditional. According to your November 30, 2015 letter, the Partners had stored <br /> approximately 257.3 acre-feet of water in the Overland Trail Reservoirs under 00CW251. <br /> Replacement water from the Overland Trail Reservoirs is proposed to be pumped into the Cache la <br /> Poudre River at approximately the same location as the Treiber Lakes and Lamb Lakes. <br /> The total amount of replacement water to be released is 195.9 acre-feet for 2016 and 154.3 <br /> acre-feet for 2017. See Table 6 for the projected monthly replacement schedule. <br /> Long Term Augmentation <br /> In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado Division <br /> of Reclamation, Mining, and Safety ("DRMS"), all sand and gravel mining operators must comply with <br /> the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the <br /> protection of water resources. To prevent long term injurious stream depletions that result from <br /> mining related exposure of ground water, future operations will include constructing slurry walls <br /> around each of the five ponds to construct water storage reservoirs. The Partners obtained a <br /> conditional water right for these future reservoirs (collectively known as the Overland Trail <br /> Reservoirs) in water court case no. 00CW251. The owners and operators of the mining site are <br /> municipal entities and thus a bond to cover the cost of lining or backfilling the pits is not required. <br /> Conditions of Approval <br /> I hereby approve the SWSP in accordance with 5 37-90-137(11), C.R.S., subject to the <br /> following conditions: <br /> 1. This plan shall be valid for the period of January 1, 2016 through December 31, 2017, unless <br /> otherwise revoked or modified. If this plan will not be made absolute by a water court <br /> action by the plan's expiration date, a renewal request must be submitted to this office <br /> with the statutory fee of $514 (2 DRMS permits x $257) no later than November 15, 2017. <br /> 2. Well permit no. 75423-F was obtained for the Home Office Pit by Lafarge to cover their use <br /> and exposed pond surface area of the gravel pit in accordance with 5 37-90-137(2) and (11), <br /> C.R.S. This permit is now held by Martin Marietta Materials and currently covers <br /> evaporation from the three Lamb Lakes that are the subject of this SWSP. <br /> 3. Well permit no. 77301-F was obtained for the current use and exposed pond surface area of <br /> the Treiber Lakes in accordance with S 37-90-137(2) and (11), C.R.S. <br /> 4. The total surface area of the groundwater exposed in the Lamb Lakes after December 31, <br /> 1980 must not exceed 61.8 acres, which results in an evaporative loss of 141.19 acre-feet <br /> per year. The total surface area of the groundwater exposed in Treiber Lake B must not <br /> exceed 25.6 acres through May 2016 and 0 acres after May 2016, which results in an <br /> evaporative loss of 16.69 acre-feet for 2016 and 0 acre-feet for 2017. Should the total <br /> surface area exposed exceed these amounts, an amendment will need to be filed with this <br /> office. <br /> 5. The amount of water used for slurry wall construction at Treiber Lake B shall not exceed 20 <br /> acre-feet. All pumping for slurry wall construction shall be measured in a manner <br /> acceptable to the division engineer. <br /> 6. Total consumption at the Treiber Lakes and Lamb Lakes must not exceed these <br /> aforementioned amounts unless an amendment is made to this plan. <br />
