Hickenlooper, Governor | Mike King, Executive Director | Virginia Brannon, Director <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br /> <br /> <br /> <br /> <br /> <br /> <br />January 21, 2016 <br /> <br />Mr. Randy Geist <br />Loloff Construction, Inc. <br />801 8th Street, Suite 130 <br />Greeley, CO 80631 <br /> <br />Re: Loloff Construction, Inc., Loloff Mine, Permit No. M‐1985‐112, Amendment Approval, <br /> Revision No. AM‐01 <br /> <br />Mr. Geist: <br /> <br />On January 21, 2016 the Division of Reclamation, Mining and Safety (Division/DRMS) approved the <br />Amendment application submitted to the Division on January 12, 2015, addressing the following: <br /> <br />Amendment to change the post‐mining land use to Developed Water Storage (Slurry Wall) <br />and increase the affected area to 46.94 acres (4.24 acre increase). <br /> <br />The terms of the Amendment No. 1 approved by the Division are hereby incorporated into Permit <br />No. M‐1985‐112. All other conditions and requirements of Permit No. M‐1985‐112 remain in full <br />force and effect. <br /> <br />The revised financial warranty amount of $1,104,455.00 exceeds the $689,552.00 financial <br />warranty currently held by the Division. Please submit a rider or a new financial warranty per <br />Rule 4.2 in the amount of $414,903.00 within 60‐days (March 21, 2016) from the date of this <br />letter. The amendment will not be final until the financial warranty increase is approved by the <br />Division. <br /> <br />The following stipulations incorporated into the permit with the approval of TR‐01 will be <br />terminated with the final approval of the amendment application. <br /> <br />TR‐01 ‐ Stipulation No. 1 <br />Loloff Construction, Inc. will purchase and decree to the Office of State Engineer (SEO) <br />adequate water rights to cover the remaining 15.4 acres of exposed water in Phase 2 within <br />120 days from the approval date of TR‐01. The 15.4 acres of exposed water surface in <br />Phase 2 will require an additional 45 acre‐ft (2.92 acre‐ft per acre of exposed water <br />surface).
