This is a review of the requirements of Rule 4.15, the establishment of a diverse, effective ad <br />permanent native vegetation cover on all affected land. <br />J. DRMS Jan 2016 The abridged permit was reviewed for compliance with Rule 4.15 of the <br />Colorado Mined Land Reclamation Board. The abridged permit adequately meets the standards <br />of Rule 4.15. <br />Rule 4.27 Multiple Seams & Steep Slopes <br />This is a review of the requirements of Rule 4.27, Operations on Steep Slopes and includes a review of <br />variances and reclamation and design standards for steep slope operations. <br />The only referenced in the abridged permit regarding Rule 4.27 exists in section 2.05.2(1) pg. 5-1 and <br />state a steeply dipping seam with extraction consisting of one thick coal seam. <br />Review of the Findings Document associated with Permit Revision 4 issued in May 2014 states that: <br />The Division approved a variance from meeting approximate original contour for reclaimed areas. <br />This variance was proposed following a demonstration that the requirements of Rule 2.06.4 and <br />2.06.5 had been met (4.27.3). In addition the Division believes that the applicant has <br />demonstrated that the requirements of Rule 4. 27.4 will be met. <br />The applicant has proposed alternative specifications and practices for operations on steep <br />slopes and reclamation of these operations. This proposal has been accompanied by a thorough <br />analytical demonstration that use of the alternates will result in reclaimed areas as <br />environmentally sound and structurally stable as would result using the standards set in 4.27 <br />(4.27.3(8)). <br />K. DRMS Jan 2016 DRMS finds that the operator has adequately complied with the terms of the <br />approved variances.
