Section III - Status of Stipulations <br />The stipulation history for the Carbon Junction Mine was reviewed as part of the midterm <br />review. The review included an investigation of any stipulations imposed since the last <br />permit renewal, and any responses to existing stipulations received since the last permit <br />renewal. Any stipulations associated with this permit and issued over the life of this <br />operation which are not discussed in this midterm review have been complied with or <br />terminated. <br />Permit C-1992-080 has no active stipulations. The most recently active stipulation, ST10, <br />was complied with and removed from the permit in August 2008 after the verification by <br />DRMS of soil loss equations in Technical Revision 15 and the approval of a Minor Revision <br />regarding 2008 vegetation data. <br />Section IV — Permit Variances and Specific Approvals <br />As per Findings Document associated with Permit Renewal 4 issued in 2014: <br />A. The Division approved a variance from meeting approximate original contour for <br />reclaimed areas. This variance was proposed following a demonstration that the <br />requirements of Rule 2.06.4 and 2.06.5 had been met (4.27.3). In addition the Division <br />believes that the applicant has demonstrated that the requirements of Rule 4. 27.4 will <br />be met. <br />B. The applicant has proposed alternative specifications and practices for operations on <br />steep slopes and reclamation of these operations. This proposal has been <br />accompanied by a thorough analytical demonstration that use of the alternates will <br />result in reclaimed areas as environmentally sound and structurally stable as would <br />result using the standards set in 4.27 (4.27.3(8)). <br />DRMS finds that the operator has adequately complied with the terms of the approved <br />variances. All reclamation has been carried out and the variance is no longer necessary. <br />Section V - Enforcement Actions <br />No enforcement actions occurred since the last permit renewal in 2014. <br />Carbon Junction Mid Term Review #5 Page 4 <br />January 2016 <br />
