Reilley, DRMS <br />Document Location: Document Location: M\\Coal\rar\MidTermReviews <br />Rule: 2.05.6(3) Protection of Hydrological Balance <br />January 2016 <br />Page 3 <br />This rule addresses the evaluation and determination of probable hydrologic <br />consequences, the hydrologic reclamation plan, protection of surface water quality, <br />water rights, and control of discharge. The review was undertaken in regards to <br />consequences occurring after underground mining. Adherence to rules 2.05.6 and <br />4 are adequately addressed in the following: <br />o The Proposed Decision and Finding of Compliance for Roadside Portals SL -08 <br />(October 2015) <br />o Annual Hydrology Report for October 2013 through September 2014 <br />The Division finds that the measures taken and analysis performed have been <br />adequate to ensure protection of: <br />1. Surface water quality and quantity within permit area and adjacent to <br />permit area <br />2. Users rights to water <br />To summarize information in the above cited documents: <br />Outfall Number <br />Status <br />001 <br />Ceased flowing in March 2002, reclaimed in 2008 <br />002 <br />Ceased flowing in March 2002, will remain as backup to <br />outfall 016 <br />015 <br />Never put to use <br />016 <br />Perpetual and consistent volume of gravity discharge <br />from mine consisting of groundwater inflow <br />Ponds <br />Ponds 1, 2, 6, 8, <br />9, 10, 11 and 13 <br />and sewage <br />lagoons <br />Reclaimed to Phase I <br />Pond 7 <br />Reclaimed and requesting full Phase I and II release <br />Impoundments <br />No permanent impoundments will remain <br />Further hydrologic investigation for certain areas as outlined in SL -8 will be undertaken. <br />As per the conclusion of SL -8, there are no signs of erosion or instability. Pollution of <br />surface water is not occurring and is not expected to occur. <br />
