Russ—Thanks for the schedule update. Items 1 and 2 will go directly to the BLM without copying DRMS. I will
probably copy Jim Komatinsky at Mesa County on item 1 since the county could become involved if an accident
were to occur on 5/10 Road or John Brown Road.
Item 3 should not affect your review because we were drilling with mud rather than dry, so very little information
could be collected on ground water conditions and I don't believe that any of this info changes the evaluation and
conclusions reached in the submitted plans.
With regard to the request for info on the water treatment system; I will submit an as-built report next week that
will include a revised report by Lyntek that specifies tanks rather than ponds. I will also include a copy of our
approved permit with DWQC. I would prefer to see this report released, as it better reflects what we are doing.
No portion of this report will be considered confidential.
Even though your review will not be completed until the 16th, I would prefer to wait until then to do the actual plan
revisions. However, I may respond to BLM's comments in a letter so those issues are addressed for the ongoing
EA. I know that DRMS's comments will affect the Plan of Operations as well as the 112d. For example, David Bird
of DRMS is requesting additional information on seal locations while the BLM is requesting additional information
on seal design. It only makes sense to include both of these additions in both the 112d and Plan of Ops since
they are intertwined.

We are working on our comments. I have several people working on different parts of the review currently. I
need their input prior to releasing anything simply because several parts intertwine. I have a few and am starting
to put it together but it may be the 16th before I have everyone's approval to release it. I'm hoping sooner, but
there are several schedules on our end involved. There are a few things that should be noted: Items#1 and 2
below are non-jurisdictional and we will have no comment on them. An Emergency Response Plan on site will be
looked at but not for off site transportation. The Division does not look at cumulative affects for proposed
permits. One main reason is it requires subjective review on issues that may or may not ever occur. Our rules
don't require such review at this time. #3 please define"evaluation" are we talking water quality, quantities, etc?
We're looking at the data submitted but if there is additional information forth coming then it will require more
review by the hydrologist and possibly others. One thing that will come up is a request from the Division to
release details of the DRMS approved water treatment plant. I will need a letter authorizing the release of the
information as it was approved under the NOI and is technically Confidential. It maybe a good idea to approve
the release of any information under the NOI that EF doesn't consider proprietary.
